I would expect some strange laws in the future with congress giving itself the ability to manipulate domain name ownership... seems like they are trying to bypass WIPO:

Republican congressional candidate Robin Ficker is suing one of his primary election opponents over control of Ficker's Web domain name.

Should we tell him its a good idea to register ROBINFICKERSUCKS.COM too? :)

WIPO and UDRP are just standardized methods. Lawsuits work as well if both are in a jurisdiction that can serve the other one.

It was probably done this way on purpose. a lawsuit could potentially be quicker in a local jurisdiction, as well as have the ability to get a quick injunction against use while being decided. A lawsuit would also make more of an impact in the headlines since local newpapers watch for court and public records, but probably don't look for UDRP filings. a lawsuit could also effect a person or organizations credit record as a potential liability.

I would image the timeliness of elections has a lot to do with the way this case is handled.
