Should I be worried?

Hello everyone

I'm a newbie and have few questions.

I have registered two domain names yesterday.
One of them being a .net and the other .com
.net domain has three dictionary words.
There is another company that has same domain name which was registered in September of 2014 with .com, as of right now they do not have any trademarks.
Potential of the company with .com is huge, they will be a publicly traded company very soon, so I am sure they will start working on trademark.

The second domain name I have registered is a .com
This domain name has three words. First two words are the same as the other company, but the third word is different.

I have registered both domain names with intention to establish a lead generation company.
Note that both I and the other company compete in the same business, except that they provide service in particular industry, and we generate leads for the same industry with out providing services.

Can any legal action take places because of same name, with only difference .com and .net?
Should I be worried about anything?
Should I start and keep doing business until they contact me?

Thanks

The views expressed on this page by users and staff are their own, not those of NamePros.
Based on what you are saying, you are aware of the potential for confusion.
The other company could argue that you registered the domains in bad faith, because you should have known a conflict was likely.

The question is:
Would you have registered these domains, had the other (competitor) domains not been taken.
I hope the stakes are worth it, if you want to take a chance.

Well, what I understand is that because there are two domains registered, one of being exact .net and the other semi-exact .com is a risk.

It is possibly going to be less risk if I keep one of them.

If you have your fears then it would be better to take another domain name and do the work. Since you are almost sure that they would come for you. The marketing expenses and the time you will take to establish a website online would be wasted, added with the legal complications if they come in the future, so since you are aware about a very genuine threat its better to avoid them. Moreover you have stated that the .com was registered at Sep 2014, so its easy for them to nail you, being in the same industry also would work at your disadvantage.

Better to opt for a new domain that could serve your business in the long run, without any confusion of any sort.
It is good to have your own generic name that does not resemble any other already established business because it might harm your integrity & reputation and may further establish your competitors brand as the lead one.
