.us CAUTION: Buying from sellers who aren't in compliance w/nexus agreement

I purchased a domain from a gentleman (and fellow NP'er) who was not in compliance with the neustar agreement. Ironically, on the day I purchased the domain, Neustar had run a scan and the whois info still showed the seller's information (an address outside of the USA).

Neustar conducted a nexus check, sent out an email to the seller, and was going to delete the domain as the seller was not in compliance with the nexus agrement. Despite the domain being in my account and under my whois info, I was never contacted by Neustar about this process. In fact, the seller brought this proceeding to my attention and was gracious enough to offer me a full refund.

Because I still wanted the domain, I called Neustar and spoke with an attorney there. Luckily, the attorney was very nice and agreed to get things straightened out. In the end, I was lucky to be able to keep the domain only because the registrar incorrectly allowed the domain to be pushed to me while it was under nexus review.

Lesson #1: If you don't comply with the Neustar nexus requirements, you are at risk of losing you entire investment!

Lesson #2: You should tread carefully when purchasing domains from someone who is not in compliance with the nexus requirements. There could be a nexus check occuring on the domain and you may never know about it until your domain is deleted.

It sounds like you got pretty lucky in the fact that the seller was willing to refund you and Neustar was willing to allow you to keep the domain. Thanks for sharing though! In the future I will check the WHOIS info of sellers for their address when buying .us domains.

And as an aside, glad that they are finally policing their own policies.
Just my .02; many domainers disagree, I know.

Allan, Neustar's enforcement still appears selective at best. I have run numerous scans and have found people that appear to be in violation of Neustar policies. One would think Neustar could scan its entire whois database quickly to spot potential violators.

In my instance, the domain I purchased had just dropped and gone to a pool auction. I'm not sure if someone contacted Neustar or Neustar just happened to run a scan on the same day the pool auction ended.

Let's at least pretend that we plan on enforcing rules/laws/whatever - otherwise just get rid of the darn things :notme:
