Trademark issue and Overture.com stats

Hi,

I have been offered a good price for the domain paintballers.net and was after a bit of advice.

The person offering has asked for the following:

"1) Trademark issue. I must be sure that your domain does not have any conflicts with any existing trademarks. In other case it can be rewarded to other organisation and I'll lose my money and time. If you don't have a registered trademark for your domain please send me another kind of proof.

2) Type-ins statistics for your words from Overture.com. I must
know how often people type your words on search engines. I need names with good type in statistics."

What is actually asking for in point 1?

Also, I have been to Overture.com but can't work out how to get stats - do I have to sign up? How much will that cost?

I am a little wary as this was a response from http://domains.Profit.com which some people have warned may be a scam.

Definately be weary and watch out for phony 'buyers' requesting that you get paid appraisals before they'll make an offer. It's a common scam. I suspect after you answer the email above, the guy will respond and request that you go get a paid appraisal (at one of allfordomains sites). Don't get suckered!

In response to your questions, you can check for trademarks at http://www.uspto.gov/main/trademarks.htm

I checked the term 'paintballers' and there are no registered trademarks to the term. My opinion is that it's a generic enough term meaning a paintball player that it there would not be a trademark issue with anyone. You should suggest that if they are concerned, they do a trademark search prior to purchase.

For Overture type-in statistics go to
http://inventory.overture.com/d/searchinventory/suggestion/

try searching for "paintballers" and "paintballers.net" The numbers it returns are what he's asking for.

Both questions are quite odd because those are both things he can check himself. Watch out for that appraisal request, and don't spend any money with scamming companies.

I have had a reply from another person asking me to get an appraisal from greatdomains.com and fastdomainsales.com but I have told him if he wants an appraisal from them that he will have to pay for it himself.

I'll send the other guy the trademark and Overture info and let you what happens.

Good move. That's their standard ploy.

Greatdomains doesn't even offer appraisals anymore. When they did, they were $79 per name. It's mentioned just to make the other choice look low priced. FastDomainSales is a part of Allfordomains.

Good luck with this other guy. I hope he's legit.

RJ is right about the TM and Overture ? thingy, they could have easily checked for themeselves, sounds fishy to me.

Click "New User Form Search (Basic) "

Input your term and click Submit Query.

Any somewhat knowledgable buyer would check these before contacting you.
