I just noticed that the Sunrise TM application on the domain Casino.eu has been ACCEPTED by the registry!

Holy Crap! I wonder how they accept TM on generic names like this!

Well Eurid have outdone the porn industry in producing what can only be described as a proper fsckup. :)

As easy as it is to submit in a total messed up registry ;)

EURid.eu statement:
"Please note, however, that EURid is a registry (technical agent), not a judicial, executive or legislative body to be able to determine the legitimacy of a holder's claim to a domain."

So happy submitting and hope nobody adresses it to www.adreu.eurid.eu - LOL

I am amazed. I did a trademark search under Benelux ,Europe and even International trademark search and it shows me there are quite a number of trademarks on the words POKER , CASINO , and yes even the word SEX.

And it's more interesting to see under which class is each TM.

Don't be surprised to see casino under telecommunications or poker under Health products (ex).

Since the whole system is fuzzy but follows some rules , one way to prevent the stability of the system could be to not let the owners of the domains use it for something else than the products or services covered by the TM.

Then we would come up with a site ex sex.eu selling flowers, and casino.eu selling mobiles.

At least it will be funny

depends on where . Eu or USA or....? I think it's depending on the country TM office . There is also an issue with the timeframe the TM is registered. For international TMs it takes much more time for your application to be accepted. For national TMs it's faster sometimes.
I think you (we) need an expert on this

The last examples we saw in .eu landrush with the socalled faked TMs from benelux had a starting cost that I think it was around 350 Euros or something.

Domain names can not be trademarked.
They can be at maximum a service mark i think.
A trademark application is done over a given word.

Here comes my example, that some NPers may remember.
Register_com sued me cause I controlled NewRegister_com.
And the intereswting was/is that it was based on their trademarked term "register" wich seems to be enough to threaten nearly any domain registery with that term in the name :ghost:
That time they tried on me.
TMs are not white not black, but way.... grey - lol

But over all IMO many of those .eu based on TM applications are just a fake taking advantage of the mess created at Eurid.
There are at least 3 dutch entities so that faked sucessfully TM in .eu landrush applications.
Eaven more, it seems Eurid doesยดt eaven care if you inform them.
(Simillar tactics apply for the 100s of bogus .eu registrars thet don`t eaven have a website)
