Absent that, a private business can largely do as they please.
Any judge would throw this out because it has no merit in law.
It would be tossed out by any conservative judge as well, the same way all of Trump's bullshit voter fraud lawsuits were.
If "a private business can largely do what they please." then why can't a baker deny making a cake, because it goes against their religious beliefs?

I have no idea what the Michigan state laws are. It is possible that they don't have the same discrimination laws as Colorado.

If you put sexual orientation into federal law as a protected class, then that is one way to fix it.
The federal law would take precedence over the state laws per the Supremacy Clause in the Constitution.
The Supremacy Clause of the Constitution of the United States, establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the "supreme Law of the Land", and thus take priority over any conflicting state laws.
On a personal note, I would give most private companies wide discretion when it comes to who they decide to do business with, but any policy needs to be posted publicly for all to see.
