Hey guys, I just have something I want your opinion of.

I live in Toronto, Canada and I was on the subway. You know those subway banners they have in the trains and on the station platforms?

Well there was a website they were advertising called www.canadianflyers.ca

I want to check it out. The link was dead. I checked if it was registered or not and it wasn't!

Someone really screwed up. So I registered it! :) :hehe:

I double checked to see if I made a mistake, I did not.

Do you think I got lucky or what I did was pointless?

The odds of this happening are almost nil.

It's very expensive to advertise on TTC Subway.
They made a very very expensive mistake lol
How's the traffic? Is TTC ad effective? :D

LOL I don't know if my TTC ad I put up is effective or not. I just registered it.

I'll update you all and tell you how effective TTC ads are haha.

Similar thing for me too today. Hand Reged a domain that someone was advertising in the local newspaper. :hehe:

I wouldn't really call it "I made it myself" but I just changed the keywords and the pictures.

I tried groceries but I got stuff like "Real Mexican dishes" so this is the closest relevant keywords that I thought someone MIGHT click. So I chose them.

I know this is not appraisals, but do you think I should go with my camera, take a pic of it and sell it? I will say its a decent name with subway advertisements in Toronto Canada, but I will be sure to say "It might last a day, or a month" etc and maybe I can get a bit of money for it and reinvest it?

I wouldn't say calling me an idiot is called for.

I don't believe Canadian or the word flyers can be tradmarked. Second of all it was an error in the subway ad. As Canadianfliers.ca Canadianflyers.com Canadaflyers.ca etc etc are not relevant to the topic of the billboard so it there is no typo problems here. It was just a massive screwup. Anyways if this is the direction this topic is heading for it will be my last post in this thread.

You're inviting potential TM issues. But then again, if they cannot spot this kind of error, I suppose they wouldn't even notice your existence. My guess is you're safe.

Sorry if I wasn't clear. I'm not the best at expressing myself sometimes.

What I mean't was all possible similar domains or variations of this name are about non-related themes of that the billboard's theme was.

So there is no worries about legal problems.

Like if supergreatsweetcomputers.com has a subway ad that had pictures of planes on it, and all other variations of the names such as .ca or .com had no plane-related or travel content I would say I am in the clear of domainsquatting or typosquatting. Someone just completely and totally misheard the name and wrote the wrong thing on the billboard.

So it is safe to say this company does not exist. And even if someone decided to register the company I was first to make a website about it so I wouldn't be forced to shut it down. Such as the case of Utube.com which is a oil company or something (I forgot) they were around longer than Youtube.com and they were allowed to keep their site cause they registered it before it was a TM issue. I could argue this in court if it ever came to that which I highly doubt. Also such a generic name like CanadianFlyers.ca I don't believe can be trademarked as they are just so generic. This I might be completely wrong about though as the last statement I said was just a guess.

And no, letter for letter canadianflyers.ca is written the same as the billboard I saw.

b. Evidence of Registration and Use in Bad Faith. For the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration and use of a domain name in bad faith:

It is safe to say a company does not exist by this name.

It is unlikely but this is the probable situation that has happened:

"Hey I want a subway advertisement for 2 weeks at such and such stations. I want it to have a few travel pictures on it. Write in a big font "Candafrequentflyers.ca" and thats all. We don't have a logo so put up a generic non-TM pictures of planes and travel.

Thanks"

The TTC employee somehow is drunk or completely mishears and says "Sure. It will be up on the 15th." Then he goes and writes something totally unrelated such as "CanadianFlyers" (Such as Canadians who fly on airplanes alot.)

Thats my guess as I said ALL other possible variations of this name either don't exist or are about unrelated topics.

Anyways I appreciate everyone's feedback but I don't want to keep this topic alive as its going to keep going and going. I said my peace and just wanted to let you guys know.

There is a flight training company called Canadian Flyers which has a website at CanadianFlyers.com. Seems as if the posters were produced with .ca instead of .com. Impressive catch on your part, good luck!

Both variations "Canadian Flyers" and "CanadianFlyers" do not exist.

But I doubt it was a screwup with the .ca instead of the .com
Flight schools have a very very narrow market. It is simply not worth TTC billboards in my opinion. But maybe your right. Who knows. Like I said its a freak occurance. :) Will do ONE more post after this of the said subway poster pic which I will go make now.

And to the gentleman who said he mean't no ill will. No worries I didn't feel any ill will from you. We are just in disagreement but I completely respect your opinion and you may be right, but I believe it can be argued in court. So thanks for the feedback sir! :hehe:

It would be funny when the person looks at the Canadian Flyer's ad about airplane and goes to the website, he gets confused as there is a grocery related website :P

I think advertisers for TTC spend thousands (tens of thousands in some cases) /month.

Significant active outdoor advertising ... looking around $40,000-$50,000/ month?
