I was reading Ricks blog and let me tell you... The gloves are off!

The starting of all this came when Jay stated on his blog that Rick had bid on Shopping.mobi and backed out, which turned out not to be the case. Here is Jay's post, which is now corrected, but the damage was already done. http://blog.domaintools.com/2007/11/mobi-moniker-auction-looks-like-a-deep-rabbit-hole/

One thing that bothered me in this whole story and was not fully talked about in Rick's blog, is Stephen Douglas who "Was" Roundtables Executive Producer for the 2007 show has left NI and is suing NI for contractual reasons. IMO, Stephen was a HUGE part of making the RT auction a great sucess before, during and After the event. He went to great lengths to help me out getting paid for the domains that I sold at RT's auction and helped many people here. Who know's, if it wasn't for Stephen, we still might not of been paid.

Now I have serious questions about submitting any future domains to RT's future auctions with so many people getting very upset with Jay.....

Rick is a bulldog. Don't mess with him. He will bite you bad. I think he fights harder for what is right than most domainers. Here it is his reputation at stake. Rick has helped more people than anyone I know of and his "tell it like it is" style I find very refreshing.

Rick, your good name will not be tarnished, only because you defend it.

Sounds like Jay needs a fact checker on his staff. It also sounds like the early workings of a defamation suit.

The one thing that caught my attention on Rick's blog was this:

"E. Finally, Jay wants to hijack the subject of "Transparency" the subject that TRAFFIC announced it will focus on in our Las Vegas show in February. Fine, let's start with Jay. With his way of doing business and selling private info about others.....He certainly proved he does not have the credentials to lead the way into a transparent business."

Unrelated to the overall theme of defamation, but it is good to see that Rick is taking the side of privacy rights. Maybe they are both tw*ts as described in the earlier post (cracked me up), but one of the tw*ts is right and the other wrong on the .mobi bidding issue... and of course even tw*ts are entitled to real and punitive damages in a court of law.

It's two separate issues.

Stephen Douglas left NameIntelligence because of a commission dispute.

Not because of the "squabble".

This is by his own words at successclick.com.

Quote: "I currently have a lawsuit filed against him (Jay) for breach of contract and gross underpayment for my commission as accorded me by my contract."

He does add that he does not support Jay's views and goes on to say:

"...letโ€™s hope my contractual issues with him (Jay) work out quickly and favorably. I canโ€™t say much more at this point other than Jay and I have severed all ties, and from my professional viewpoint as a domain consultant, I have no negative perceptions of Marchex, Enom, Snapnames, Oversee, Moniker, TRAFFIC nor Rick Schwartz in their concerns and do NOT endorse or advise Jay in his blog comments or positions he has taken against any domain industry company or individual. This is my professional statement in order to make sure current and future clients of mine be informed that Jayโ€™s comments and opinions are his alone."

Would he have left if there wasn't a contract dispute?

I don't know the man so who knows?

That is correct!

I could careless if Jay and Rick are pissed at each other. I am wondering with the power that Rick holds in the industry and the people that follow him, if this is going to affect any upcoming Round Table auctions. (These are some of the big buyers in the industry)

Secondly, Stephen was a very big part of the RT auction and he is now gone, so I wonder again, how much this will effect the next DT auction.

This could be the reason that DomainTools has not said anything about the Nov auction Jay announced on his blog about 2 weeks ago. It's now mid Nov, so I do not see a Nov auction happening with DT.

I will think twice about submitting domains to a company that many are pissed at. Who knows how it could affect the outcome of the auction.

It is pure nature of business, for this to have happened. happens every day, especially with entrepreneurs, Shit happens, Shit falls through, It is the nature of business it self, Imo

I am sure all will get worked out between the two.
