Can't you just taste the trademark Infringement...

myspace is a trademark of "news Ltd". They are very aggressive, and myspace is a trademarked Domain.

Did you know that you don't own a domain name unless you own the trademark for the corresponding business name? Without a trademark, you might think that you own a domain name because you have registered it, but in actual fact unless you have a trademark, a person or company with the same trademark as your domain can make you give it up.


Without a trademark, you do not own your domain name. :)

They can't touch you unless you are hurting them or selling the same product they are or taking thier product away from them. Since FreeMySpaceGames.com doesn't offer blog hosting, but offers Flash Game Codes and to play arcade games it is fine.

I suggest you do some research over the subject.

Just to show you some other websites that have been around and will stay around just like this one.

I suggest you host it upon on at least a 200 GB bandwidth plan. Since plan's at hosting services vary it would be hard to say a cost for the bandwidth.

Myspace might have a trademark on the domain name myspace.com BUT they do not own freemyspacegames.com of any other domain that might include the general term myspace within its name. I have a business call welcome to myspace which has been in operation AND trademarked for 20 years....Well prior to myspace.com I should go sue myspace for taking my name…..RIGHT. My business sells personal furniture and myspace.com DOES NOT…. Atleast not yet. You see The similarities of the goods and services involved (including an examination of the marketing channels for the goods); is a major factor in determining trademark infringement cases…not your opinion.

Go read the Federal Trademark Dilution Act. Previously, federal law gave protection to the infringement of a registered trademark, while unregistered trademarks were protectable with the law of unfair competition. Trademark dilution had been recognised in many US states, and became federal law in 1995. It is not necessary to establish that there is competition between the parties in a dilution case, whereas previously "passing off" had to be proved.


BUT the law is on your side as long as you are not in "Direct Competition with them"

Agreed, nice site and good luck with the sale. No TM issues here dont listen to the TM crew here at NP they tend to not know what TM law actualy is. Watch for them to bully the site, but they have no legal backing.

An update of the Rev for the first offical day with advertising:

Stats are coming. The server doesn't update the stats until like 9 a.m. my time.

7$+ on the first day without being index in google and msn. With little advertising. Whoa. Can't you just see the money.

Link to the stats. They didn't update them until noon my time. :( They are getting slower. It show's traffic from yesterday and alittle bit of of today's traffic. First day was faster then expected (257 uniques) and growing and growing. Like I said this site is going to take off fast. Made 12$ ypn from 12 mid ~ 4 a.m. the cron hasn't updated yet for the time it is now.

So, this is going to close in another day. I have a bid of $1500 . So, get bidding.

The site has been sold and consider this closed.
