I have a good friend who is thinking of developing the 2 sites. i am seeing the popularity of the .tv growing. I came across the site and suggested for him to allow me to get an appraisal or feedback. I may encourage him to sell the names.

Google hits for newsweek 21,000,000 citysearch 60,300,000 Wow. I think he can get major $$$$$$$$$ for these. Please advise.. Thanks

When will they ever learn.

But speaking of TM issues there have been a number of times recently when i've made note of a TM concern, usually after someone else mentions it and the seller says something like "i checked and i dont see anything to be concerned about" or "its a generic term, how can there be a tm?". i almost always include data straight from the pto website and ever time my posts get deleted and the sale continues on.

What gives?

Only a guess, but all of this thread will dissappear soon.

1st, it's more of an appraisal.

2nd, the reason the posts vanish is because anything that isn't directly part of the sale is not allowed per the rules. So if you are just posting info, even though pertinant, it isn't allowed. Happens all the time in other sections.

Quite frankly, if you have a TM domain, then know one in this section is likely to buy it, or if we do buy it, then it is on our own head. Buyer beware being the motto of the day.

I myself have a domain that is trademarked in the UK, but not in the us, so I can do whatever I want with it to a degree. But that doesn't mean I couldn't sell it in here. Someone from the UK would probably post that it is a TM, but as long as the buyer isn't in the UK, then it won't matter. Sure, you could face an International court order, but it would be fairly easy to argue that I didn't know about the UK tm as long as my site had nothing to do with it.

Respond.com got into a trademark dispute with a UK company over the name "Respond". So even generics can have issues. We were able to negotiate a cross link promotion to them to get us out of the dispute.

These two domains...ICAN will have the final say, but my guess is they will be viewed as poaching.

I had learned this last year when I was brand new to namepros. I registerd Nasdaq terms and didn't realize they were trademarked.

So I gave the names up and got my refund.

I suggest you do this on newsweek.

I am still holding 2 names that could be in trade mark dispute and I won't mention them. If any trouble does arise I will be happy to give names up. Seems I am not the only one doing this on those 2 names. One name I plan to keep, just change my ads and I will be ok. The other one I don't plan to renew.

I think a good portion of people have done some sort of trademark.

To the owner, just learn from the mistake and be careful registering names. I learned from the past year.

A good example actually. How can you TM a so called generic - but it does happen.

With something like this, it then comes down to how it is used and what keywords are used etc. Bottom line though, it can be a hell of a mine field and if they have the legal muscle to not only only start, but pursue legal action, you have to ask yourself "is it all worth it". A good result IMO was Local negotiating a mutually beneficial deal.

Yes if you go in the way back machine for Respond 2003 (below) you will see the link at the bottom of the page. I don't remember if that deal expired after so many years because the link got removed, but the link was required by the settlement.

As WWF/WWE found out, you don't screw with TM issues and don't violate terms if you get a settlement. The World Wildlife Federation laid a smackdown on the WWF.

This is neither a sales or an appraisal thread (Appraisals are for domains you own, not a friend or a company). Feel free to discuss however you like, these are obvious TM domains and have no resale value. Offering them for sale is bad faith that will make it even easier for the tm owner to take the domain.

Tell your friend not to waste his time. As mentioned, they have TM issues & are worth $0.
