META.is, a small business operating in the immersive and experiential technology industry since 2010, today filed a lawsuit against Facebook. For 12 years, META has powered the types of experiences and products that Facebook is now building and has served the same creators and consumers that Facebook is now targeting. META's lawsuit, filed by Pryor Cashman LLP, alleges that Facebook unlawfully seized the META mark and name — willfully violating META's trademark rights and engaging in egregious acts of unfair competition.

This case is about ensuring the collective protection of rights to our work, innovation, and intellectual property, which we have devoted our lives to building—as we evolve towards a more equitable digital and social future.

Facebook talks a big game about supporting creators, but the proof is in their actions. If they’re willing to blatantly seize our IP and use it in the same spaces we have operated in for more than a decade, we can’t imagine what’s coming when they further saturate our industry and dominate the “metaverse.”

This lawsuit is bigger than our company. The outcome will have major implications for the protection of intellectual property rights as the Web2 and Web3 ecosystems evolve.

Another company that claims to own the META mark despite their trademarks being filed and registered after Facebook's ones:

Their trademarks are figurative as well, not word marks, which in reality probably only means that their design is protected as is displayed in their trademark filings, not just the word META.

Quite a weak set of goods and services described as well, I suspect not providing much protection in terms of services that overlap with Facebook's:

"Media production services, namely, video and film production; entertainment, namely, production of community sporting and cultural events using digital, virtual and augmented reality filmmaking and interactive displays of lights, sound and motion; special event planning for social entertainment purposes"

"Arranging and conducting special events for commercial, promotional or advertising purposes; Event planning and management for marketing, branding, promoting or advertising the goods and services of others; Social media strategy and marketing consultancy focusing on helping clients create and extend their product and brand strategies by building virally engaging marketing solutions; Special event planning for business purposes; Organizing, arranging, and conducting live interactive marketing promotional events for business advertising purposes"

Why didn't they oppose the meta trademarks if they were so infringing?

I guess reality got under someone's skin... (Given the down votes). It's called research by the way, in case anyone is interested. I looked for the truth and found it, then I posted about it, not the other way around. 🍼

Fun to watch. meta.com will be transferred to meta.is ? Everything is obvious, UDRP conditions met. But DS would use alternative methods to discourage meta.is from doing it.

How? It's the other way around...

(i) the domain name registered by the domain name registrant is identical or confusingly similar to a trademark or service mark in which the complainant (the person or entity bringing the complaint) has rights; and

Yes.

(ii) the domain name registrant has no rights or legitimate interests in respect of the domain name in question; and

Facebook have many meta trademarks, predating meta.is. complaint fails. Meta.is has a registered trademark for meta for other services, Facebook's complaint fails.

(iii) the domain name has been registered and is being used in bad faith

Not required, due to the other condition met.
