What now?

Now the application sits there for maybe nine months or so and does nothing. Sometime after that, it gets examined and refused for being a generic acronym for electric vehicles.

Too many people believe too much dumb stuff about trademarks and trademark registration applications. There's just no way to fight back against the things people believe which simply are not true.

DomainGang writes these lazy pieces on trademark application filings, but doesn't do any followup or serious analysis of them.

For $300 anyone can file anything with the USPTO. So there is a regular chain of stupid stuff that gets filed. Most applications like this one simply go off to die without much attention.

The acronym “EV” stands for “electric vehicle” (see attached excerpts from www.acronymfinder.com and www.thefreedictionary.com; Google search engine; February 27, 2009). Applicant’s goods are electric vehicles.

The generic top-level domain (TLD) “.com” merely indicates an Internet address for use by commercial, for-profit organizations and, in general, adds no source identifying significance. E.g., In re Oppedahl & Larsen LLP, 373 F.3d 1171, 1175-76, 71 USPQ2d 1370, 1373-74 (Fed. Cir. 2004); In re Martin Container, Inc., 65 USPQ2d 1058, 1060-61 (TTAB 2002); see TMEP §§1209.03(m), 1215.01.

The proposed mark in its entirety is merely descriptive of the goods.

The word "tide" is generic for what the moon and sun do to the ocean level. The word "tide" is not generic for detergent, for which it is a famous mark.

So, when we talk about whether a mark is "merely descriptive", we mean "merely descriptive of the goods or services for which it is claimed as a mark".

But, finally, I have no idea what "hemp water" might even be. That said, there are a lot of people selling liquid products they call "hemp water", which seem to be prepared in a lot of different ways. So, I doubt that the term "hemp water" has any particular descriptive or generic meaning. But one thing is clear, it is not a registered mark for any of the liquids sold as "hemp water" under various different brands.

...and part of the reason we know that is because a lot of people tried to register it for a liquid product, and the USPTO routinely rejected those attempts, or required registration on the Supplemental Register:
