I am new to community. And I am seeking little help here. I am in domaining shortly, bought something and now I am in situation that I need information to clarify what to do with my domains.
I mostly registrated domains for my own projects, but I seeked for nice names.
And because I have limited time as everyone, I probably let some domains for sell.
And here is the issue. When I am passing some staff not exactly for free it brinks some responsibility to me.
Sure I can always let domains drop, but It took me plenty of time to learn about tham.
And now I am standing before toughest part - the law system. To be honest I didnt find it really fair. And as sidenote I can add that next generations will have more and more saturated and unfair system.
Let me describe problem:
AI told me that I might have some problems with my domains usecase because of TM conflicts.
Let me describe that with example. Go to atom.com and seek for some awesome domain names.
For example I like word "Lush"
Atom returns 1803 results of names with "Lush" baked in.
And AI crying that I cant use that with connection to beauty and cosmetics.
So I use some specific filters at atom.com: "By Category" and choice "Beauty and Cosmetics" shrinks list to 927 records.
So if I follow AI advices than I cant use thouse 927 names.
Because there are registrated trademark for "lush"
If I make exact match for trademark Search: trademark.io/free-trademark-search?query=lush&country=&statuses=Registered&classifications=&mode=exact&page=undefined&query_term_on_load=lush&spelling_variations=yes
18 Trademarks found for “lush” (sure its simpified, I should be look for more databases)
And here is main problem.
If for this common english dictionary word (adjectivum) exists some of classes of TMs you need for your business .
ei: class 44
Does autimatically apply that any further variants with word "lush" cant use for your business?
Example (from name shop atom):
LushRainbow
LushWild
LushSpot
So basicaly TMs of term "lush" basicaly gatekeep your business to using word lush in your name?
You cant make TM for class 44 for example for Lushora?
So you cant use LushSpot or even Lushora? No neologism allowed? Or AI just halucinate so heavily?
