I just took a look at the latest UDRP decision transferring domain names to MetaPlatforms.

It is decision D2022-2341 of August 18, 2022.

In the "4. Factual Background" section of the decision (page 2), it states:

" According to the WhoIs records, the disputed domain names were registered on October 29, 2021, one day after the Complainant publicly announced that it was changing its name from Facebook, Inc. to Meta Platforms, Inc. "

In part "C. Registered and Used in Bad Faith" (page 3), it states:

" Because the Respondent registered the disputed domain names the day after the Complainant publicly announced its name change, and noting the strong reputation of the Complainant and at least its FACEBOOK mark at that time, it is implausible to believe that the Respondent was not aware of the META and FACEBOOK marks when it registered the disputed domain names. "

October 28, 2021 is clearly a key date, it is a recurring element in all decisions granting domain name transfers to MetaPlatforms.

i'm wondering what they mean by the term 'used in bad faith'?
do they mean registered and put on a lander or contacted meta with an offer to sell or developed in some way? if ' used in bad faith' means put on a lander with a bin or make offer, we're all doing that.

I wish, one of those companies, that call themself meta, would in the same way attack meta platforms inc. and sue them for their meta name... :xf.smile:

They would have deserved it.

Just laughable how you can do that (sue others, but not get sued).

Also, I think - if we take it like that - the only company, that may would have something to say, is the very first company called meta.

All others just came after it...

[If we take for granted, that meta is not a generic term, brandable, trademarkable etc.]

To me though, meta is and was always an abbreviation for the metaverse term, like verse or mv.

UDRP cases are based on the "Uniform Domain Name Dispute Resolution Policy", which is available on the Internet Corporation for Assigned Names and Numbers (ICANN) website.

For the applicable rules regarding the notion of bad faith, see point "b." under "4. Mandatory Administrative Proceeding" :

b. Evidence of Registration and Use in Bad Faith. For the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration and use of a domain name in bad faith:

(i) circumstances indicating that you have registered or you have acquired the domain name primarily for the purpose of selling, renting, or otherwise transferring the domain name registration to the complainant who is the owner of the trademark or service mark or to a competitor of that complainant, for valuable consideration in excess of your documented out-of-pocket costs directly related to the domain name; or

(ii) you have registered the domain name in order to prevent the owner of the trademark or service mark from reflecting the mark in a corresponding domain name, provided that you have engaged in a pattern of such conduct; or

(iii) you have registered the domain name primarily for the purpose of disrupting the business of a competitor; or

(iv) by using the domain name, you have intentionally attempted to attract, for commercial gain, Internet users to your web site or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of your web site or location or of a product or service on your web site or location.

These are not cumulative conditions, only one of these elements needs to be present for bad faith to be proven.

Look at the point "(i)" : Buy a domain name in order to resell it... for more than the price you bought it for...

@Andy Power : MetaPlatforms is being sued by several companies. The cases are still ongoing or have been discontinued because MetaPlatforms has acquired the IP portfolios.

Got metaverte .com from GoDaddy closeouts for $77. I watched it at auction and didn't bid to keep it under the radar..

Once auction ended with 0 bids and it went to closeouts, I hit BIN within 2 seconds cuz I think other people were watching it..

Apparently verte means green in French but I'm not too sure if verte or vert is the right usage..

I think it is a good typo of metaverse that has a meaning. Saw that metaverde and metaverge sold within the last 2 months. One for $1.1k, other for $4.9k. Verde is green in Italian I think..

Any Thoughts on these 2 Metaverse Names? Both in .COM extension.

I understand they are not the actual word (wish I did own them!) but they are well recognized abbreviations of both particular words.

Yeah, I think they do. Many articles about "meta" also mention multiverses, spheres, realms, so whatever.
