UDRP 0NE (.) com defended

Successfully defended UDRP matter of 0ne.com (starts with numerical) against one.com group AB (Sweden) before ADR.eu (CAC). Complainant alleged cyber squatting and had served the Respondent (@Coindoji) with a cease and desist notice.

But it is not uncommon to find numerous domain names with alpha-numerical combinations like tw0.com, t3n.com, b0x.com. Therefore, allegation as to cybersquattings could not sustain, given ‘one’ is a generic term. The Panelist has very well explained the position when it states that ‘no one can own a number or dictionary word to the exclusion of the rest of the world’. Matter would have been different if it was strong / distinctive mark.

Further, the Respondent had the domain name for sale through parking page and is a crypto currency trader, holding other crypto related domain names. The legitimate interests of Domain & Crypto investor upheld. While no Bad Faith registration or use could be proved against the Respondent, as the main purpose of holding the domain name was his interest in crypto and never the Complainant was targeted.
