advice Buyer not paying, marketplace says to push domain to them anyway

Hi everyone,

I sold a LLLL.com domain in an auction and the buyer wanted the auth code but ir was still within the 60 day lock, I had transferred to new registrar. I've always pushed the domain to the marketplace and never had this issue. Anyway, the buyer told them they would wait the week or so until I could provide the auth code. The day the auth code was available I sent it to the marketplace (about 3 weeks ago).

Marketplace sent the buyer several requests for payment (reflected in transfer area) and yesterday I asked Marketplace if they had heard from the buyer and this was the reply I received today:

Nov/09/20 xxxx Transfer Agent
"Thank you for your message; unfortunately we have not heard back from the buyer. As such, please go ahead and push the domain to XXXX's Epik account with the information on the left column. Please kindly check to make sure if you are able to opt out of the 60 day lock while pushing the domain that you do do so. Once the domain is received there, we can proceed to release the payment to you. Thank you."

The agreement is between buyer and seller, and nowhere does it state Marketplace will purchase the name on behalf of the buyer if they don't pay, it actually states "In the event that either party fails to perform all reasonable steps necessary to submit payment, complete the transfer of control of the Purchase Object, or otherwise fails to communicate with xxxx’s representatives in a timely manner, xxxx LLC or xxxx GmbH shall have the permission of the Parties to cancel or temporarily suspend attempts to transfer said Purchase Object and to demand the commission from the Party who has failed to complete all reasonable steps necessary to complete the transaction."

Yes I will be clear the domain sold VERY cheap and I honor the price won by the winning bidder, but I don't have a commitment to the Marketplace because I didn't sell it to them. If the buyer never pays now they own the domain? Something here seems wrong to me.

Any thoughts on this??

They are just using pre-written messages and maybe picked the wrong one. I would just wait until you get the message that says the buyer paid, or wait until they give you more clarification or start sending you warning notices.

Where did they say the buyer did not pay? Cause I am not seeing that? They said "Once the domain is received there, we can proceed to release the payment to you. Thank you"
which means the payment is with them but they want you to deliver the asset and get paid.

The buyer wanted the auth code to transfer out of current registrar. The marketplace wants me to push the domain to them to their Epik account because they haven't heard from the buyer.

when I asked if they had heard from the buyer.
Heard back as in whether or not to wait and have the name transferred to their preferred registrar or simply have the name pushed to a new account in the registrar where you currently have the name? This is how I understood. No marketplace would say send a domain if they cant pay you.

I see your point, maybe the buyer paid and they just can't reach them now to transfer the domain. Let me check on that. (Probably should've done that first before posting) Sometimes one just needs the voice of reason, which is why I request advice from you guys. I will post again if issue remains...

Turns out Im an idiot (who knew? lol) The buyer paid a long time ago and the marketplace was just trying to facilitate the buyer's request to transfer out. They are doing right by me after all!

So used to getting shafted my mind automatically thinks the worst.

Thank you everyone, I was wrong! At least I got to vent, thanks!!

Aha, so it was how I thought. Good. Again, no marketplace would ask you to transfer or push a domain if they dont have the money. This happens many times and actually this marketplace is doing you a favor by saying push the domain and get paid. Later they will deal with the buyer when they hear back from him or her and are able to either let the buyer keep the domain where it is now or transfer it to their preferred registrar.

09/11 is yesterday. Why are domainers so impatient and expect instant money when was it ever instant?

The issue here was not instant money, it was feeling like I was being wronged.

This didn’t start yesterday this started over 1 month ago and I thought the marketplace was doing something shady that had nothing to do with the money part. If you read the post in its entirety you will see that.

I’ve been in this 21 years and I had a senior moment. It happens. I jumped the gun on the situation and I admitted I was wrong about it.
