information Just Sold a TM name today

Spaceship Spaceship
Watch
I own an .org name and the name was registered in 2008.
I got an email from a man saying he owns the trademark of my name and wanted me to hand the name to him or he is going to file for UDRP.
After checking I see that he filed the TM 5 months ago on 04/2020.
I told him that the name was registered before his filing for TM and he has no leg to stand even if he files UDRP. Beside it's going to cost him money.
So I gave him 2 options: Go ahead and file or buy the name from me as I am not a CyberSquatter who registered the name AFTER seeing his TM.
After a couple emails back and forth he agreed to buy the name. The money is in my bank now.
It's a small transaction under $100K

No it doesn't, only those that can't think for themselves, read or don't give a crap will do it ......so nothing really has changed

I have trademark domain name of a $300 billion company. TM filed on 2014 but the domain was registered in 2008. There was no website on that domain till now and I'm also keeping GoDaddy default page.

Hoping for the best deal :xf.wink:

If it the one I think it is then......very nice

To be fair there are less than 20 companies with a market cap that size and above :xf.wink:

Read the OP's post. The domain was registered long before the TM was filed, so there are no issues with it.

as far as I know
there is no safe haven when it comes to TM names

a trademark registered yesterday may make you lose your 20-year-old domain name
-in case you violate their rights-

this can happen fast
when you park them

I am facing something similar now I think. Buyer negotiation that is becoming negative.

Watch this space.

Good job OP!

If you park them, violating their TM rights, then yes. Don't needle potential end-customer unnecessarily.

If you park them " for sale" , no. If you use for non-related projects, how can it violate rights?

a "for sale landing" is not what I refer to as "parking"

Thanks johnn, i used to use;

https://knowem.com/checktrademarkavailability.php

Yours seems more legit; But also good to have options.

Original USPTO database .gov search website is convoluted. like US wants u to hire lawyer just to search for the dam TM!! (let alone defend it)
While I agree, these must be the biggest places to search.

https://www.uspto.gov/trademarks-application-process/search-trademark-database

Search point

Worth remembering that many sites have usage trademarks. They aren't allowed to add R or TM unless they have actually registered a Trademark.. Otherwise they are breaking the law and that can go against them.

Copyright can be added but that's something totally different.

You can use TM next to your brand without filing for a TM. You cannot use the R though. Bar some exceptions in some countries.
