I own an .org name and the name was registered in 2008.
I got an email from a man saying he owns the trademark of my name and wanted me to hand the name to him or he is going to file for UDRP.
After checking I see that he filed the TM 5 months ago on 04/2020.
I told him that the name was registered before his filing for TM and he has no leg to stand even if he files UDRP. Beside it's going to cost him money.
So I gave him 2 options: Go ahead and file or buy the name from me as I am not a CyberSquatter who registered the name AFTER seeing his TM.
After a couple emails back and forth he agreed to buy the name. The money is in my bank now.
It's a small transaction under $100K

Congrats @johnn.

Phenomenal for a dotorg. This wud easily be one of the top org sales. Unable to understand the connection of music genre with a dotorg though.

Great Sir, The last line is very encouraging. If someone gets a mail like this many wouldn't know how to deal with this. Thanks for the insight.
Your website Wesellname is too good. How did you design it. Its Clean and Simple.

Indeed, his website is very clean and search friendly but it says "Not Secure". I think something is happening there with SSL certificates.

Anyways, Congrats @johnn for the sale and thanks for sharing.

I received a lot of private messages asked me to:
- Brokerage your domain
- Advice on Legal TM issues
- Trying to sell your name to me
- Ask me how can you sell your name.
I am only sharing the story based on my situation.
I am still leaning everyday and if you notice:
- I never post or provide appraisal
- I am not qualified to provide brokerage services
- If I want to buy your name I will contact you - don't need to send PM
- I am not a Lawyer and cannot answer your legal questions - Consult your Attorney.

Thank You for Your Understanding.

Congratulations on the sale @johnn

It's important, though, to clarify that a TM holder's right to a domain name has nothing to do with when they registered the TM. It has more to do with how the domain is being used and when that use started (compared to the commercial ventures of the TM company).

I think this is a crucial distinction. Domainers should not feel safe to advertise/sell products and services under a domain name that has been trademarked for a similar use simply because they owned the name before the TM was registered.

Soo.....

If you own a business a trademark will help with.....

Brand Protection - think about all the years of hard work that has been put into your business and how people engage with your Brand and the perception it creates......

Reputation - Potential Investment into your company, known as being trustworthy, reliable, good quality etc

and the profits that can be generated from the above....

Then some lazy idiot comes along after you have built a strong, profitable and sustainable company and decides to squat on your hard work and try and make a few quid from it and that company is stupid for wanting to protect it's rights?

:xf.rolleyes:

Get a grip.......

Edit

What @johnn has done is not infringe on any TM - you saying that any TM is stupid....is well......stupid

What other defense is there beside trademark? Is there a better way?

Well put. I'd like to add that TMs are actually designed to protect both the business and consumer. When I buy an apple phone, I want to be sure it's a quality phone, produced by apple. Not a cheap knock-off. It works both ways.

As a domainer, the mere fact TMs exist actually make my domains more valuable. What's not to like about them?

Don't feel scared/intimidated by TMs but read, learn and make it work in your advantage. That's what OP is saying with his post. Plus bragging about his > $1 sale :)

First you need to use your own picture in your profile. Then you will begin to understand what a trademark is.
This is my foto 🤣
