So, some idiot paid $800 for this domain name, made a custom banner to advertise it in specific association with the movie franchise, and thinks someone is going to pay $100k for it?

If this is something that strikes you as a good idea then, please, get out of domaining immediately.

Let's use this James.Bond domain example where you have one strong trademark holder.

If the .Bond registry decided to price this at, say, $50,000usd instead of their usual registration fee, is there any legal argument that a trademark holder could use?

I know this a tangent from the thread topic, but it is a curiosity of mine none the less.

@jberryhill , why did @Internet.Domains close his account, I wonder if the GoDaddy Cartel had anything to do with it.

It's bad enough that they intimidate and threaten people here on the forum, but they sent out some phony domain verification emails to a handful of people here (including me) and now they are messing with my Afternic and GoDaddy accounts.

That's what happens when some companies get too big for their own good, their employees start abusing the influence and control that they have over their customers while the high ups and the attorneys in the company just look the other way.

Well I hope this post gets their attention because if they stay on the same course then soon they'll have to face up to the consequences of their actions (or their inactions), of course by then it might be too late once everything is brought to the open.

Looking at the ad banner, I can say there is no doubt it is using the TM, whether the ad belongs to the registry or to registrant is another thing for discussion I think. Keeping a domain like that for 800 year fees is not also a good investment. I can use that money to renew 90+ domains every year.

It's not about if James Bond it's a TM or not, it clearly is, but your tone is disgraceful. I've sold hundreds of domains in the last few years, but I've never heard of a single domain sold by you. So, you are here just to make yourself better known and to fish some new clients, but you can afford to attack the others who actually sell domains. This is not the first time and for sure it will nit be the last time, to bad that the mods agree with you and let you spit on others, who actually are selling domains, not just debating TM's. I wonder what @Mod Team Alfa @Mod Team Bravo @Mod Team Echo will say about this...what will happen if I will start talking to others exactly the way you talk, I can bet in the next second they will delete my posts, but you can say whatever you want.

Before the New gTDLs came out around 2014 or so ICANN gave first choice to TM holders through the Sunrise period to register their brands before the domains were released to the public,

Also there was the Trademark Clearinghouse (TMCH) program that helped TM holders protect their brands,

In addition there is currently a mechanism that allows for infringing domains to be taken down quickly.

After giving all these protections to TM holders ICANN also gave some perks to the New gTLD registries to hold back up to 100 domains for their own use for the purpose of promoting their registry through third parties.

Considering all this and the fact that the TM holders haven't taken any action to take the aforementioned domains or the banner down, it's logical to assume that whoever is promoting these domains is going to continue doing so regardless of what the people on this thread might think.

Is what they are doing morally right or whether it is considered to be against the acceptable practices within the domain Industry is a different matter than whether it is illegal or not, and the fact that the banner keeps running even now is an indication that they feel safe to do so, who knows they might have made some kind of an arrangement with the TM owners that was mutually beneficial to them.

Nevertheless it's best to learn all the facts around this case before passing a judgment.

What if the domain name is owned by someone who hold a license with rights to produce, sell james bond staffs ? he have right to own it, what if the seller is situated in a country where james bond TM not registered ?

And since it probable that in the future there will be a female BOND, we can expect a new name to be reserved for this extension, will it be also a TM, especially that the names are public and already owned and used by folks since decades.

How big registrars like Godaddy, NameSilo, Namecheap, Name.com and others accepted to serve this extension for public use ? It is clear that it will be used for this purpose ! who will reserve keywords like this now a time: bitcoin.bond, car.bond, etc. it is clearely not matching and looks to be for a different purpose that they appear ... who will accept to pay 800$ for an extension like this one while there a tons of them and in better quality ?! Other than the guys of the movies themself ?

If I was named james (or not), I have right to reserve my name with this extension, why others could and not me ? In the case the content will be related to James Bond movie there we can talk legal actions, but for now I see nothing illegal.


The one to blame here is the registrar it self and not the seller IMO ... instead of shooting delibirately insults against others it is preferable to build arguments that passes and convice others and not taking them by idiots without any sense.

I am new and noob here and in domaining, but qualified in a different domains on the web, I touched for many of them ... used many old known services that are already died right now ... developped many applications with old and new programming languages, online shopping, webmaster of many projects, early adopter of cryptocurrencies, moderator of many forums etc ... but I never taken my self as an expert and taking down others, I have questions about the topic and need informations before judging or taking part of any side ... but allowing this type of reactions seriousely ?!!!

It's pretty simple what the seller's intent is based upon. Is "James" middle name "007"?

The ad text is "James.Bond & 007.Bond" in a leaning font which copies the presentation on movie posters, DVD sleeves, etc.. Additionally, the advertisement includes the partial image of a man wearing a formal suit, as is typical of the James Bond character.

One has to be a complete fool not to be able to determine that the sale is premised on the James Bond "007" character and rights in that character.

Over the last two decades, I have successfully defended more domain names than you will probably ever sell. You are pro, amazing, you know everything etc. wathever you want, but your words and the way you are threating others that don't pass and no normal humain can't accept this type of returns, it's limit insults to participants... normally you are an example to follow and it shouldn't me who will take this kind of speech, I understand well why @Internet.Domains requested to close his account ... hope he will come back here and focuse on his business (there is many other members here and we are not all with same mentality) and trying only to avoid, black list this type of member ... it don't worth to go beyond this stage and moderators should set a limit and give their point of view even if they are a reputable members ... you are the only police here and we should respect only your chart and not the one of every pro member.

.bond doesn't have premium domain names so it seems. I'm not sure if ShortDot has their own premium sales venue. I can't find it. They wouldn't be the first registry to be selling premium names directly through a marketplace. This would be a nice way to be able to not have premium pricesd names and yet being able to sell for premium pricing.

On top of that, the registrant shows as ShortDot. Ever noticed the shutter reference in the .bond logo? Guess why they came up with that?

Finally, there's only one reason a banner like that would pass Namepros screening as appropriate advertising, and that would be if it's payed for by the registry, ShortDot.

I highly doubt NP would approve such a banner from a random domainer.

I agree, the ad is designed properly. I was more thinking of the fact that it is an obvious TM infringement unless ShortDot has some agreement with the James bond TM owners.

Surely NamePros won't condone these practices unless they do have an agreement. It wouldn't be very professional now would it?

Thanks for that. .bond states on their website they don't have premium priced domains. They probably circumvent this self-imposed limit by making ShortDot the owner so it is actually owned by another legal entity.

Bit of speculation but so far everything is pointing in that direction.

I predict that after the ads run for a while longer and the registry gets enough promotions out of them, the domains will be given to the TM holders at a discounted price. Perhaps this was the arrangement from the very beginning, but until all the details are revealed about this case people should not make any conclusions and they should certainly not attack or insult other members who are engaging in a civil discussion on the forum.

There is a well known history of abuse and bullying here on the forum by the almost 1500 GoDaddy employees and those who are somehow affiliated with the company, but I draw the line when they start messing with my domains and accounts at GoDaddy or Afternic every time I make a comment on the forum that they don't like, as I said if the higher ups and their attorneys continue looking the other way and ignore this situation then I will make things more clear about my experience with them, I rather have friends than enemies so I am giving them a chance to bring this situation under control before I take any further actions (That's all I am going to say about this until I see whether they are going to correct this situation or not).

It made me upset that @Internt.Domains was insulted and attacked by the same Cartel to the point that he had to close his account.

As to what I am talking about, I will give more details of how they have been messing around with my GoDaddy and Afternic accounts if things don't change for the better.

So back to the original topic of the thread.

Let's not pass any judgments about this case before all the facts are known, and more importantly let's keep the conversations on the professional, constructive, and respectful side.

On a brighter note...The domain name Abject Stupidity is available to hand register.....only hyphenated though. The non-hyphenated version has already been registered lol. Neverceasestoamazeme. com

I have heard people making these accusations before. Never have seen any proof of that.

I'm not a GoDaddy fan but those are some serious allegations that would need some backing up to be taken seriously.

I don’t know why someone would try to pay that much but I’m glad they did. I have 0007bond.com and it’s for sale. I only bought it because of an inside joke for a friend who was getting married and we made a bond in college that was not a great idea.

I’ve since changed my views on many things. Like marriage. It’s a great institution for those who like institutions
