I might get burned for this, but this is my opinion and if you don't like it well just let me know :xf.smile:

For anyone on the Libra is a constellation or old Roman weight bandwagon and it is all fine and dandy to register Libra names for resale because it's a generic word you have entirely missed the point.

You have registered these names to try and sell to companies who will be working in the same space as them, I mean way over 1000 plus registrations within a week AFTER the Facebook announcement.

Are people are going to plead ignorance to this and say I got this name for a sky mapping project or I am a big fan of Roman weights? Come on, you don't become a multi billion pound company by not aggressively defending your Brand.

Also Facebook have acquired trademarks which predate their announcement....... just in case you grabbed some names before then.....

The Korean Intellectual Property Office rejected Facebook's application on the 9th May for Libra as there were already 4 trademarks in use within South Korea.

"Industries which KIPO cited as being pre-registered include:
-management of investment portfolios
-online financial planning service, data tracking of cryptocurrency transactions for accounting surveillance and monitoring agency service
-online project development management service and support service for others’ startups."

On top of the above LG also had a trademark for Libra watch which was cited as well.

"The Libra trademark had also belonged to other companies in the United States, but Facebook acquired the rights to the trademark in the U.S. from those other companies."

So if Facebook can not Trademark it's own currency name in a country what do think the chances are that any other company working in this space will want to buy these names and face getting sued?

I am personally glad not to be involved in this space, I did have a day or 2 of thinking about grabbing some names but decided it would not be worth the risks......

The lack of understanding on this is ridiculous and I will not posting on this thread again as people who have these types of names have their opinion and i have mine and that is not going to change because of a few sales....if your looking for justification Libra fans I suppose you have it now 😉

this makes no sense at all. what about a company called libra laundry with a tm ?? would they not have the legal right to sue samsung then since they too use libra and have a tm?

Only if Libra Laundry have also included Mobile Telephones, IT and Networking in their Clothes laundering business.

These are two entirely different things. Also the Laundry Co will only be able to TM their logo. They can't TM doing laundry or Dry Cleaning.

Samsung don't do laundry so they are not interested or threatened by the Libra Laundry or vice versa.

When it comes to TM.
1. You don't have to have a TM for every variant to state that your rights have been infringed upon. (Conflicts with Nr.2 I know)
2. TM's are issued for specific usage areas. Not every single thing ever thought of.
3. Trademark law protects distinctive words, phrases, logos, symbols, slogans, and any other devices used to identify and distinguish products or services in the marketplace.
4. Trademark "ownership" is not absolute. You can use the TM for editorial, informational and educational use or for comparing products. I have LibraPrimer.com.
5. And finally, the guys with the most money WIN, if recent history teaches us anything.

An aspects of domain name space, fb can always refer to libra as unregistered tm, if they so wish. It would still be TM for lets say UDRP purposes.
They can't use TM without approval. That is illegal. When it is granted they can stick TM beside it and then do things.

The term “trademark or service mark” as used in UDRP paragraph 4(a)(i) encompasses both registered and unregistered (sometimes referred to as common law) marks.

Well anything is possible. Look I would never want another domainer to not make money, so I hope Libra does surprise all of us skeptics.

But the truth is as it stands it is a huge risk.

That depends, if you purchase 10 Libra domains at low hand-reg prices, the amount of money you've put in is next to nil, so it isn't exactly a huge loss. On the flip side, if it does turn out that there will be no TM issues, that tiny risk has paid off..?

Look the only thing I would say is Facebook actually purchased a trademark that specifically mentions financial/crypto services.

If Facebook had no intention of holding a trademark for these services then it would not of purchased it.

People keep saying the trademark belongs to another company. But if Facebook purchased the trademark, it doesn't matter who the previous owners were, the new owners will be Facebook.

Yes I understand people will do a few reg fees. But by the looks of it some people have been going crazy.

Like I said I would never want a fellow domainer to lose money so I hope I am wrong. But I think it's pretty straight forward. Why would Facebook be applying/purchasing these libra trademarks for the financial/crypto sector?

BTW I would never want anyone to take my advice and not register something they believe in.

If people have researched and still feel OK with what they have researched, then by all means go with your head(y)

Facebook is building financial services around the currency called Libra. They are doing this under the brand Calibra. The TM they bought is for tax services in the blockchain and crypto industry. The head of Calibra said this week that they will roll out financial services over time such as loans and credit. Clearly they have Tax services lined up as well.

The TM does not apply to the currency called Libra, unless your in the Tax business.

@libradomains on twitter has a portfolio of over 100 libra domains for sale on flippa...We'll see if it gets any bids...some pretty good names in there!
