A little less than 1 year ago, Francois Carrillo of Domaining.com, lost ADO.com in a UDRP. Many wrote about the decision from DNW, to Gerald Levine and I wrote a piece here as well that looked at a deeper potential problem with logos. It seems like Francois successfully settled out of court and has now retained ADO.com. TRTL.com broke down the whole timeline and it looks like Francois … [Read more...]

Thanks for sharing.

That is very good decision at the end.

In reality that name were never purchased with bad faith to start with.

I wonder what leverage he would have, and why a company of that size would settle? It seemed they had some leverage in winning the UDRP?

This is good for the community. Unless it’s clear cut that a domain is being used in bad faith, a complainant should never win a case.

Seems to me that a bus company, well, they just might just stay .MX regional unless they are planning to grow wings.

Showed interest to buy ADO.COM, pulled out of negotiation and filed UDRP. Autobuses de Oriente ADO, S.A need to sack their lawyers for advising them badly

Yes, but It's still a bad faith move. To start a negotiation and pull out to file UDRP because you think the price is high and wanted a shortcut to the domain ownership

W.Shakespeare was a prophet, apparently. The guy wrote a comedy in 1599, 420 years ago, named "Much Ado(dotcom) about Nothing".

Udrps won't be around for long

Just like whois

Europe stopped the whois completely for Europe

And Europe will stop all Udrps sooner rather than later because the uk has a compensation claim culture and Europe won't allow people to buy Website addresses for investment and then a Udrp takeaway their investment because the domain name wasn't trademarked & patent checked by a legal team before being sold etc that won't be allowed in Europe and the uk

Europe stopped MLM pyramid that left the person at the bottom of the pyramid with stock they couldn't sell etc all such practices didn't and won't last long in Europe especially when you consider 3rd of the world's biggest legal firms are based in the uk

Every domain name will need to be individually trademark checked by a domain name registrar before purchase before long

A bit like var in football in the uk Eg yes it takes longer and yes it is annoying that the decision takes longer but it will be the right decision and that trademark decision won't be allowed to be changed once trademark checked before purchase and subsequently purchased which will put an end to expensive udrps and people losing their money or digital assets because of a udrp challenge down the road
