Hey everyone,

My name is Oliver from the US.

Iv'e been looking into domains for a while but only recently found out that there is more to domain flipping than the 7 figure sales i've heard of. I have been buying some domains go godaddy recently and look to mainly specialize in cryptocurrency domains.

As for questions, I don't know if this is the right place to ask but if lets say I registered the .net of a domain and used it for my programming portfolio and than someone else got the .com and made a real product with it they can't cease and desist me right?

Yes if you registered the domain before them establishing their product then they can't claim any violation against you. So you are safe.

To start to answer your question .. it really depends on the specific mark. Trademarks aren't really about the specific domain .. they are about usage of a "mark" (term/name/saying/etc) in regards to business. If you were USING the mark first then it's you who theoretically should have the trademark.

It is more complex than that though .. like if you just had the domain registered for 10 years but never actually used the mark in business that would likely not count. You are also expected to defend and enforce your trademark, so if they've been running their business for many years, it might or might not be too late to do anything about it.

If you registered the domain first but didn't use the specific words in business, then they came along and used the mark in business, then in theory they would have rights to the mark (with some exceptions like if you can prove you were developing the business), but you would still be allowed to keep your domain (the .net in this case) .. however you would not be able to actually use the domain in a way that relates to their business. Again .. that's not because it's a domain, it's simply because you can't use the mark in any way that could make people think you could be them .. so the domain is just one part of that (also flyers, store signs, telemarketing, etc etc etc)
