Are they common? A guy bought a domain from me and keeps ignoring Sedo's payment requests.

Why did he commit to buy and then go MIA?

And the domain is not able to be listed because it has been "sold"

Have you experienced them? Are they a common place there?

the buyer was contacted by sedo several times and this person did not reply.
why shall i continue contacting him? i am not obliged.
(and i do not have illusions about his intention to buy, all what i want is to affect his credit score, he is already a debtor, i would like to formalise the situation, that's it)
Because you may get his cash including comish. You can still report them to sedo and everything else you may have wanted to do before.

Not clear, what do you mean when saying 'report him to Sedo'? He bought my domain (through a 'buy now' option), did not pay, was contacted by Sedo, Sedo cancelled everything, why does Sedo need my report? Reporting such a buyer makes no sense :) Sedo knows him and his wrongdoings very well.

Russkie, it should be clear from my posts that the priority should be to sell your domain. I keep saying use the contact info to try to sell it. You seem more interested in blacklisting the buyer so I repeated that part. Obviously, do what you like, but a smart seller still willing to sell at agreed price will now see an opportunity (even if low odds) to sell for even more if you don't deduct the sedo comish from your price.

I do belong to another philosophical school of thoughts. If a so called 'buyer' does not do the job (does not buy) within time frames given, s/he is not a buyer by definition => negotiations are not time-worthy.

moreover, i am not going to blacklist anyone (none of my business really, it's sedo's job), i just want to make sure s/he will stay away from my (and others') buy-now buttons in the future.

p.s. you did not make it clearer, why do you want me to 'report' him?

Yes, this lad can legally change his name and reincarnate as another Sedo 'buyer'. We cannot expect much from Sedo, it's their loss as well. Did anyone sue such 'buyers'? Googled, but found nearly nothing.

Nope. It will not work like this, Sedo will demand its commission, I cannot offer the domain without it.

Just catching up on this thread. Here's the relevant part of Sedo's TOS:

"In the case of a Failed Transfer, Buyer and Seller agree that Sedo reserves the right to collect any applicable fee it would otherwise be owed for a successfully completed sale from that party who has violated his/her obligation to cooperate in the completion of the transaction."

In other words, once the deal is cancelled due to non-payment, the commission is owed by the buyer, not by the seller and it's up to Sedo to decide whether they want to collect it. The next sentence in the TOS says the following:

"Furthermore, any claims for damage compensation or contractual performance may be asserted by the non-breaching party against that party which violates his/her obligations under these terms or the terms of the applicable purchase and sale agreement."

That's saying that you can complete the deal directly with the buyer which is the reason that they give you the buyer's contact information. There's nothing there that says that you're obligated to collect Sedo's commission for them once the deal has been cancelled due to non-payment. You gave Sedo the opportunity to close the deal, they couldn't, so you owe them nothing if you're now able to complete the deal on your own.

As I pointed out in my original post, the one time this happened to me, I contacted the buyer and worked out a deal directly for a lesser amount, so I think direct contact is worth trying since the only risk is that the time you put into writing a couple of emails will have been for nothing.
