Today I received the following email from Alpnames:

We have been notified by the operator of the .LOAN registry that certain domain name(s) registered to you are restricted by ICANN and that they were mistakenly made available for registration by the registry. As these domain names are restricted for regulatory reasons, the registry regrettably requires that we delete these registrations in the next 24 to 48 hours.

The name they talk about is a great .loan domain that has been registered by me half a year ago. Seriously? Has someone ever experienced the same? Are they stealing my domain? What can I do?

The name seems to have been registered last October so what it is shocking is that it took the registry 6 months to realize their 'mistake'.

Most concerning is, ICANN has no policy or safeguard for this type of callousness of the registry :!:

We have put the former registrant in touch with the registry so that he may continue the conversation directly

That's true, @AlpNames sent me the Registrar Account Manager in CC and I sent him/her my points and questions. That was 24h ago and unfortunately, they did not reply to my email so far. But I still hope that this is all a mistake.

It is frustrating, but it is not a big deal guys. sometimes registry miss some domains to be reserved/set as premium, and later they will take it back.

In this case it is restricted domain, which means it should not be available in the first place and it will not be available for individual's use anymore.

I was also mad when the same thing happened with me, i registered PERU.ooo with normal reg fee and after almost a year, i got a similar email from Dynadot that the registry is deleting the domain/taking it back. a full refund was issued.

I contacted them for clarification and then contacted the registry which confirmed that the domain should not have been available for public registration.

You can not fight with them, right ? so i just let it go. and that is what you should simply do, otherwise you are wasting your time for nothing. end of story.

Question is : if / when the registry takes back the domain, will it be unavailable for registration, or they have the right to sell it after a couple of years ?
Generally it will be locked and will not be available for registration.

I disagree with your conclusion. Someone before already stated it, that if the domain would be already built out and heavy advertised with a decent marketing budget this wouldn't be so easy taken anymore like you suggested.

As long this happens, it's at least 'fair'.
If the first owner of the domain can not longer use it / trying to sell it (becasue it was taken away), they themselve or any other should not be able to make money with it.

I had exactly the same thing with a premium new-GTLD - "in.<new-GTLD>"

India have put a block on an new-GTLD selling "in.<any-new-GTLD>" - which makes absolutely no sense in many cases - e.g. "in.<any-city-that-doesn't-exist-in-India>"

However, an over enthusiastic sales-person sold me the "in.<new-GTLD>" premium name for a significantly premium price and delegated it to me for about a month.

I'd had business cards printed and was about to launch the service when they informed me about the Indian's block, and the fact that should never have sold it to me in the first place.

They pulled the name, refunded the cash and gave me a discount on a different premium.


Mistakes happen - we're only human.

Restricted by ICANN or by the registry ?

I believe ICANN does not allow 2-character domains that are a country code, like for instance "AU".

I beleive most two-letter ISO 3166-1 country codes can now be sold by new-GTLD operators, but countries were given the option to put a block on their country - India (dot-IN) put a blanket block on "in.<any-new-GTLD>", one or two other countries have done the same, but mostly ISO-3166-1 codes are available as soon as two character names are released (which may not be on day-1).

NG used to have a blanket block, but removed it.

Fortunately, I was able to transfer the domain out and have still control over it. However, a bad feeling remains, now where I know how quickly this domain name could be taken away. I will probably never use it to build up something:xf.frown:

I personally think that it is ok that you transfered the domain out and have control over it! I disagree with you about not developing it. If you develop it this could probably save you in the long term. Maybe somebody on NP has any better advice?

We're sorry to hear that and will follow up with the registry on your behalf, but there is only so much that we can do...

Fortunately, I was able to transfer the domain out and have still control over it.

It seems the pending transfer status did cause our delete command to fail - so you beat us there :xf.cool:!!! Unfortunately, we note that your domain name's EPP status is currently "pendingDelete", so it looks like the registry took action directly. We sincerely hope that you are able to obtain a refund of the transfer fees you paid to Uniregistry.

.top registry resold to another person (I guess for 4/5 figures) months later.
I've learnt to stay away from "shady" ngtlds.

What if @loano1 had started a projected on the URL, spent $100K on promoting the URL on billboards, print etc.?

I agree that the compensation should not be symbolic.

Nothing to do here.
I've spent 5 figures to develop a .top domain, project was ready to go online in few days.
Never seen a penny for compensation (LOL), and lost 10k.
Saty with .com guys! This shit frequently happened!

Really? They took it away and sold a reserved name to someone else? A lot of times if a name has been previously registered but was meant to be reserved, the registry will still keep an active whois on it. If you look closely at the info, it is actually held by the registry. Can you please share the name?
