Hi all,

Since 1998 I registered a [BRANDNAME].com that is a big brand that many people in the world know.

Early 2000 there were two attempts to scare me with big treats of lawsuits and stuff like that but I never was really scared and they just stopped at one point and registered a .com (brand name and added word) and some ctld's worldwide. But still, I own the .com they really want or better should want. Why? Because all those years I get daily email (big orders, figures, internal reports, complaints, employee email, internal email, and so on...). Really, the list is endless. What strikes me is how clueless they all are and never ever tried to contact me (whois protect email).

I don't have to explain you all that I can't approach them directly so my question to all of you, what can I do to monetize this name (selling)? What are the best options or are there no options at all?

Again, the company is a billion dollar company. I want to help them because it is really disturbing and I also want to get rid of it. And yes, in return I want them to pay me very well, it's worth it.

Does this mean that your email is protected? didn't understand it.

Personally, I would put a 2-page site with a landing page (the second page would be an About/Contact page), and a visitor counter, and also a note that says "If you're looking for "Brand Company" try this site....and link to their home page."

Also, at the end of the day, what good is a "nest egg" from which you can't take out your one and only "valuable egg"? If you've waited 12 years and are prepared to wait however long you want just make sure your heirs know to renew...

Don't do ANYTHING without speaking with a trademark/domain attorney. Change your site... send an email. Everyone here is speculating.

Trademark law is very complicated, and the nature of the mark/domain (BRAND.com) means everything. Often trademarks are made from generic words and are given industry-specific protection. Other times they are unique and universally associated with one owner. Think Apple vs. CocaCola.

This is why you need to have a discussion with someone that you can actually explain this situation to... research the mark in question.

(p.s. if you are being honest with yourself and HAVE registered the mark in bad faith, you kind of know the answer to who is wrong in this situation. Recommended to act in some way accordingly and seek resolution if that's the case. Just my .02)

Start marketing the name as a brand for a different niche then they are in. Even go as far as to create a website with s service or a product that has nothing whatsoever to do with their business. When they see that their brand is being branded to a different niche they will contact you. This also shows that you did not register the domain name in bad faith, and that you are not piggybacking on their brand name to make money from the niche their brand represents.

Again, your best advice is to discuss with the an attorney before making ANY steps, including (especially) USING this brand name for profit. I'm not sure about others, but I've been in business 16 years, and through trademark litigation before to protect my own mark. It is not so simple as many think it is.

You need good advice on this specific case.
