[Updated] According to a statement from Oversee.net’s SnapNames, an employee was found to have bid in 5% of their auctions since 2005 and in some cases arranged for a partial refund of the sales price after winning an auction. DNN also confirmed the bidder as Nelson Brady, the VP of Engineering. He was bidding under the username “halvarez”.

To avoid any question about whether the company benefited from this conduct, SnapNames will offer a rebate to impacted customers, including 5.22% interest (the highest applicable federal rate during the affected time period), of the difference between the prices they paid in winning auctions, and the prices they would have paid had the employee not bid in the auctions. Impacted customers will be notified by SnapNames or its representative with instructions for the offer of a rebate.

SnapNames also has taken further action to ensure its policies regarding auctions are followed, and the company remains committed to taking whatever action is necessary to protect the integrity of its auction platform.

SnapNames deeply regrets this situation and is committed to addressing its customers’ needs quickly and fairly.

I am sure that is not the only reason Rick made posts about this.

One reason would be he abhors the actions of low lifes who would take advantage of a auction system. The main criteria for my thinking is how he runs Traffic.. top notch, above board. Saying that my reasoning is I think his disgust is real. Most of us feel exactly the same.

Certainly the big boys are having a wide ranging debate about the "issues".

Nice to hear John wade into the argument, i haven't seen him around on NP's for a while.

I doubt a mere mortal such as myself could comprehend all the factors involved with the big money players.

I hope they get a resolution.

Has Frank Schilling or any of the heavy Snapnames bidders commented on this yet? Did any of them get special treatment in the form of credits too, for names they won at high prices?

Frank Schilling commented in the Techcrunch blog post on this about being refunded. So far, he's the
only one who said so while the others haven't.

Not that the others are required or forced to do the same if they don't feel like it.

Peter, just goes to show that a multi-million dollar fraud is something Oregon officials consider inappropriate to investigate! Hell, you never know they might even think that crooked politicians and businessmen don't need to be investigated. Makes you wonder why these public servents are actually employed and receive a pay cheque every month, mind you perhaps not doing your job is just like any other kind of fraud. I wonder if this 'Heather McFarlane-Martinez' actually knows that this is a multi-million dollar fraud and that the company concerned has not brought charges against the so-called fraudster?

I have just emailed Ms. Heather McFarlane-Martinez, thought I would let her know that I hold such great respect for her and her office! :kickass:

if you settle and sign a waiver for snapnames make sure it doesnt absolve Oversee from everything. Just in case there is a parking scandal in the new year.

Snapbidder Id: xinamesx

Doing some research on the domain bidder on snapnames by the ID of xinamesx

Looks like all of the domain won by this bidder are owned by various companies.

Also looks like this bidder may not have paid the renewal fees on any of the domains it won at snap, causing them to be auctioned off the next year

Any info would be appreciated

Michael, nice find. It would be understandable to not renew a small percentage of domains won in auction but not to renew many or all goes beyond all reason.

My hat off to you, that is good work. :tu:

How would you know this? You seem to be guessing somewhat. All you can truly comment on is from the auctions that YOU have participated in. This could be a small amount of the auctions this user was involved in.

It is quite possible they could be doing something similar to what people like John Timmers does in that they try to win domains at auction and then selling them to people who have expressed interest in the domain. Quite possible the examples you have seen that were not renewed are ones where the sale fell flat and those that are regged to other companies being the transactions that they completed.

I have a scenario I am not sure anybody has adressed. On some auctions Halvarez was the high bidder. What happens to these names? Would the #2 bidder have a legitimate claim for the name or does Mr. Brady just get to keep these? Also He used DomainQueue for registration, There ar tons of names registered under this name which can be traced back to Halvarez. They are all parked and all potentially earning some income. If you had a claim as second bidder could you sue to get that parked income. for example:

Here is one from 2005 that Halvarez won and presumably still belongs to hime as it is still registered under DomainQueue.

In this example Halvarez won this name in 2005, assuming he has had it parked since then (it is parked now), does he get to keep both the domain and the parking income or would the second highest bidder be able to have a claim for both?

The way I see it is that this is criminal on more than one level.
#1. Brady aka "halvarez" places a shill bid, First crime = shill bidding
#2. He wins a domain by false pretenses, second crime = recievieng stolen property
#3. He parks the domain then recieves income from it, 3rd crime possible money laundering (see the wikipedia definition below.
#4. Sells of some of his illgotten domains to a third party (ireit), 4th crime another count of money laundering. Ireit could even be accused of recieving stolen property.

money laundering = In the past, the term "money laundering" was applied only to financial transactions related to organized crime. Today its definition is often expanded by government and international regulators such as the US Office of the Comptroller of the Currency to mean any financial transaction which generates an asset or a value as the result of an illegal act, which may involve actions such as tax evasion or false accounting. In the UK, it does not even need to involve money, but any economic good

So what can be done?

There's a DNF post about drop auctions back in 2005 where this bidder xinamesx is mentioned. However, I've never come across him/her in my Snapnames bidding.

"xinamesx" is an interesting bidder ID, it either has the words "names" in the middle or spelled backwards it's "xsemanix" (with "semani" being a proper name in several languages.

No conspiracy theories, it's just late at night here....

Legal authorities can't order anyone to not talk about anything, it's that pesky 'freedom of speech' issue. Anyone that says this is LYING.

As far as the 'elephant in the room' at Domainfest, or more accurately, the 'giant ball of hot stinking elephant dung in the room', we had the issue last week at Pubcon.

I was quite surprised when Victor Pitts of Moniker did a presentation of domain, and the SNAPNAMES logo was on every slide! Since there were many Snapnames victims in the room, I decided to give Mr. Pitts a very polite chance to speak to the issue by asking at the public Q&A session "Can you give us an update on the Snapnames situation?"

This was a fair question, since Oversee claims to have uncovered the situation in October, so they have had several weeks to prepare statements and 'get their story straight'.

Instead of explaining their position, apologize, or even read their statement, Victor Pitts said 'no comment'. That's a big F*** Y** to the victims of their fraud.

There now is speculation that Nelson Brady may be allowed to KEEP the millions of dollars from the sale of the domain names he 'won', including the parking revenue, and the agreements people are being asked to sign certainly indicate that the company and/or Brady will be allowed to KEEP THAT MONEY if they sign the agreement. Since Oversee has failed to protect their customers by refusing to file charges, Brady (and perhaps Kjel and other co-conspirators) are now able to flee the USA and avoid individual lawsuits.

Pretty ugly stuff.

I haven't decided if I'll be at Domainfest this year or not, but if I do I will publicly humiliate anyone from Snap or Oversee who tries to weasel out of answer questions on their fraud.

I for one have moved forward with getting the law enforcement involved. I'm disgusted by the scam/fraud and will not accept a bunch of THIEVES as executives to let their VP walk away. EVERYONE must be hold accountable. This scam did not operate for 1 week, it operated for years and millions of dollars have been raised by shill bidding.
