Thanks for the heads up, although, i was wondering if you could screenshot some proof for us? Remember to black out any credit card info.

If that is true you have nothing to stand on. That most likely gave them a chance to see the value and registered it themselves seeing how "someone" was interested in the name.

Either that, or they are scams. I would check to see if you can find out what happened at your CC company.. if there was some kind of "credit" or "refund" or something to this sort on your account.

It's 50/50 at this point. If you know your card is good, it most probably is a scam.

Additionally, you said the domain is now "unavailable" -- well find out who owns it or is the contact and send them an email from your laywer .. find out what's going on .. it's a good domain name!

Good luck either way!

Just because it doesn't look that, doesnt mean that it isn't, it would be the asiaregistry, but using a name and address of an employee.

There is no way to prove it until the lawyer comes.

I believe your case if you have one, is with the register and your cc company. YoYo sean is innocent and did nothing wrong. He registered an available domain name and paid for it.

What labrocca is actually asking is where did you do the whois lookup?

Currently, as philfischer has already stated, you don't have a chance of suing asiaregistry. It's not their fault at all.

If the cc firm denied the transaction, even if there is money, it's the cc firms fault NOT asiaregistry's. If the cc firm denies it then there's no way anyone will give you a domain when they haven't received the money and they have no way of getting the money.

It's my opinion that you just got unlucky. If you searched for it in the wrong place and someone (NOT asiaregistry) logged your searches and regged it, then it's just bad luck. Maybe it's just a case of "great minds think alike".

Take it up with the new regger, he's a member of NP so contacting him in private should be easy. I noticed you jumped on his sales thread already with legal threats. That's certainly not the way to handle it. There is a PM system, I suggest you use it before you're banned/suspended for sales thread crashing and argumentative conduct with other members.

In fact, I'm still curious about Jeff's comment. You have had other (now banned) usernames in the past? Then clearly you've been down the banning road before and haven't learnt a thing from it if you're intent on trying to resolve this in public, in other member's threads and with constant legal threats.

Try being civil, you'll be amazed at how much further it'll get you.

cc was working fine.... so get your point together... i was rejected - and my name was stolen..it has happend before with registars... go do a search on it on google.

this is unfair practise...

maybe you are right, it is a run with bad luck...either way...ive had problems with cc with godaddy...and guess what they gave me 24-48 notice to make the payment...with asiaregistry...not one email, or one respond to my emails... they are a scam and i stand firm behind it...

If you havent used your cc with asiaregistry before and depending on which country your cc was issued in and who the cc issuer is, the issuer can refuse the transaction if their system flags it as a potentially fraudulent transaction.
This, believe it or not is for your benefit ....

CC's are not issued with domainers in mind, when seconds or minutes are of importance.

BTW, how can 'your' name be stolen when it was never yours in the first place?

Or maybe you think the current US based registrant and the Hong Kong registry and / or asiaregistry are in cahoots with the implicit intention of 'stealing' 'your' domains?

the name was mine since i received a receipt indicating that the name is mine....I posted the receipt...

you know what, asiaregistry is a scam...since not one phone call or email in the last 3 days.... that should explain itself....

i purchased 800 domains in the last 8 years from 5+ registrar's....and never had an issue to cc, or getting a reply from them...

i close my case... yoyo... good luck with your sale.... the message behind all is... dont trust asiaregistry...or deal with them....

i will pay more from now on, at least ill know ill have customer service in the end.... it was my stupid mistake...that i had two windows open one for hkr, and the other for asiaregistry.... i thought i reg it at hkr...and than i realized i made a mistake and reged it from asia...

it was good catch on my behalf since i spend almost 8 hours searching for names for .hk... catching a name like pokeronline, is rare ... so my find was a success... but the registry screwed me...

like B33R said, im going to be a nice dude.... and forget about this... i spoke to my domain lawyer... and he suggested that we take this matter to hkr dispute centre.... it will cost me money ...

since hk will not have the same value and respect .com and .mobi gets...i will drop this case and never ever again purchase a asian extension... i will stick to my .com and .mobi

Forget about it!

You tell me Mr.Fish, if you owned a registrar website... and your customer's credit card was denied!

A - Would you contact your customer and inform them to choose another method to pay!

B - Look everyone, dude's visa is denied. What a good name, let's register it.

C - None of the above.

Either way, i closed my case. Time will only tell.

4000 years ago, a man told the world... that there is two sides to the universe. One side is Cold, one side is Warm.

Before the existence of humans, the two sides were at war and continue to be at war.

I'm on the Positive side. Go ahead make my day. LOL

I made a purchase, I emailed them, I called them.... not one reply..... is that the choice you want to make as a CEO?

My bad luck, YES.... but now we know that purchasing from AsiaReg, is a high risk choice. I will not make that choice again.

Domain is gone, who cares. What AsiaReg organization lost, is my money that I was going to invest. I was ready to make more purchases. I don't buy one domain, if your going to play the game, you mide as well take your chances with 20-50 names for one extension. 50 times more chances to sell one domain and cover the cost and make revenue.

The point is! I save money, and take it to a site which has excellent customer service.

GO DADDY, no hk domains... who cares... lots of .mobi choice...

hmmm.... what should i buy next... xxxxx.mobi xxxxxxxxxxxxx.mobi hmmm..... so many choices... oh, I see one PokerXXXXXXX.mobi ...

RockNet you say it is impossible that your credit card would be declined as you had $xxxx available in it.

I myself have gone into shops in the past and had my credit card declined right in front of my eyes (in fact in most cases I simply just went to a cash machine, used the same card and went back and paid cash). So it is possible that a credit card gets declined when funds are available.

Saying that they are scamming you because they did not respond to calls, emails etc. This does not make a company a scammer it indicates they have crap support.

Instead of jumping the gun and making accusations you should do some checking. Have you actually tried contacting the person who is selling the domain here to clarify matters?

Also you claim to have a receipt yet you posted an invoice. An invoice and receipt are 2 completely different things. An invoice you get BEFORE paying for an item a receipt you get AFTER paying.

To me, it looks like a total misunderstanding and a bad registry. It is probably the registrys fault, not the registars.

The right thing. Work with the customer to get him/her the domain name attempting to register on MY SITE...

And try not to be so cut throat.

Response from Asia Registry

Hello,

I am Phill Parker, and I am working in a business development role with Instra Corporation. Asia Registry is one of our subsidiary businesses.

I personally feel I need to make a response to this thread, as this person (Forum alias RockNet) has clearly exaggerated certain details, and there is also speculation on this thread that we have registered pokeronline.hk through another entity for the purpose of making an after market profit. This assumption is simply not true.

Instra Corporation has not registered this domain name, and this domain name does not even exist in our registry account. This domain name was either registered through another accredited service partner, or directly with HKDNR.

When we attempted to take a payment from this customer's credit card, we received a declined notice from our bank, and no payment could be successfully taken. Our banking merchant did not specify a reason other than the transaction was declined.
When this credit card charge attempt was declined, an email notice was sent to this customer advising that we could not take payment from their credit card. We did not register this domain name, as we were unable to take payment for this domain name application.

We have only received 3 emails from this customer, and each of these emails were sent within a period of about 15 minutes. A response was sent back to this customer within 3 days.

Due to privacy issues, I will not disclose this customer's geographic location. I would like to mention that our telephone support service is not open during this customer's day time hours. Our telephone support lines are open Monday to Friday between 12am - 4pm (GMT).

Our business primarily supports the Europe and Asia Pacific regions. When our telephone lines are closed, a voice mail message would advise callers of our operating hours.

To the best of my knowledge, we have not received a telephone call from this customer about this issue.

I do admit that we are having issues providing quick email responses to Sales and Support questions. We are however committed to improving our customer service, and we are in the process of recruiting and training new staff members.

For any urgent enquiries, we suggest that you call our friendly support team during our operating hours.

We are also pleased to announce that we have won the Best Performing New Service Partner 2006 (Overseas) by HKDNR - which is awarded by the Hong Kong ccTLD registry.

This presentation ceremony will be held on March 8 2007 at the Grand Hyatt in Hong Kong.
