This could have gone for much more IMO...my guess is the BIN was not updated recently.

Still nice 4 fig sale...but extremely under valued imo buyer got huge discount.

Short, but what do they really mean? Could've hand registered both a while ago, but decided against it.

LeanNFT.com I somewhat understand. May be there is some value to it as a directory site for NFTs, or may even be a company name around NFTs.

But what about NFTcure.com? What possible use case can it have?

People need to do some research before buying these names. I see most of these names are for sale again. Nifty is a TM and these domainers are paying x,xxx for names they wont be able to sell. Check for TMs before buying names.

May be I misunderstood it, but if a trademark usage says "Downloadable Software for so & so services", then doesn't it mean I'm still allowed to provide an online service for the same purpose if I don't provide any downloadable software?

Does having a Trademark automatically mean any and all use, or is it just a very specific set of use as described by the Trademark details?

There is a big difference between registering a TM and having an enforceable trademark.

Some of those uses are overly broad and they are going to have an extremely difficult time protecting.

They are basically trying to claim the term for online advertising and marketing services. Please. Companies already exist that use the term in many of these fields.

They will never own a generic term like "nifty" when it comes to all those listed uses. Some are far too broad.

Still we should use caution and research with all names and be aware of potential TM issues. So it is wise to alert and make others aware pf the fact TMs do exist for Nifty and to avoid infringing on any type of brand on service. HealthyApple.com, AppleTree & AppleComputers all use apple but they are 3 different birds.

Either way, even it wasnt live now and the TM became live next year or the year after, its still going to affect end-users buying these names, legit end-users will stay away from TM names, its not worth the hassle to them.

The word "Nifty" has been around a long time yes, but not in relation to NFT, crypto, Blockchain etc and thats what the TM refers to. The words Apple, Orange, Caterpillar were just generic words once a upon a time as well but they've been TM'd.

They might be able to have protection in some classes, but my point is what they are claiming is overly broad.

There is a 0% chance they will ever be able to claim "Nifty" when it comes to, for instance -

"Advertising and marketing services, namely, promoting the goods and services of others..."

They might have some enforceable protection, in narrow fields, but their application is ludicrous.

Fair enough, i believe it wil lbe approved pretty soon though. It may help with some others who are buying Nifty names and plan on selling them. :xf.smile: Not worth the risk IMO, especially if you plan on selling to end users and not fellow domainers.

Yeah they mention a lot of services in the TM, I get that. Software was just an example I've used. But my point was, there's still a lot of use cases that doesn't violate the TM.

For example, I've registered NiftyFYI.com - mainly to blog about NFT, tutorials, news, how to create/sell NFT or may be even provide some services related to NFTs. Does this use case violate the TM? From a quick glance I didn't think so, but I may be wrong, my understanding of TM descriptions are still a bit shady :xf.frown:

Anyways, you're definitely right on one thing, many people are not even checking the TM issues.

It will be interesting to see if it does get approved. Since the Winklevoss twins have already been using Nifty with NiftyGateway...I imagine they'll dispute the TM app

IMHO, that's the best part. Many people are using Nifty (or at least intended to) for NFT since the beginning of the inception of NFTs. So if a company gets the TM approval of a wide range of usage, then others will surely challenge that. That will mean no one will get the generic TM on Nifty. At best may be they'll get it for some very specific use cases, but for that too, they'll probably have to file a new TM at a later date with new use case details. That'll save people who are buying related domains now.

CryptoMedia applied for TM in NIFTY and NFT both and both are generic terms as per my understanding. I don't think they get the TM so easily.

My opinion is I hope you didn't already listen to other opinions here and accept that. There are only seven ART sales according to Namebio, but five of them are between $4k and $12k.

The $12k sale was less than two months ago and is NFT related.

ART is where ALL the interest and attention is with NFTs - NFT is synonymous with ART at this point - and as well as X being a great prefix for a mainstream site, the adult industry is only just starting to wake up to NFTs.

Playboy recently annouced it's jumping on the NFT bandwagon:

Excellent thinking snapping up XNFTS and XCRYPTO too.
