Domain Trademark Question

Hi everyone. I see a lot of people talking about trademarks and how serious it is but maybe I am just not getting it but what would happen in the following hypothetical situation:

- Bob registers a domain with no bad intentions.
- Bob puts a for sale sign on the domain and waits to be contacted.
- Bob never reaches out to contact any buyers.

Let's pretend there is a trademark that Bob didn't know about. If the lawyers contact Bob cant he simply tell them here you can have the domain? It only cost Bob $8 to register this domain and he doesn't care if he loses it.

1. What the worst that can happen if Bob simply decides to hand over the domain back?

2. Can the lawyers find out Bobs info if he has domain privacy enabled?

3. Will the domain registrar block his entire account due to that one trademark domain? Will they charge him a fee if it goes to udrp and he loses?

4. I guess what Bob wants to know is if he unknowingly registers a trademark domain, why is it such a big deal if it only cost him $8 and he doesn't care if he looses that single domain.

Thanks :xf.smile:

The most important thing to note is that if you deliberately register active trademarks, you are cybersquatting .. and more importantly harming the reputation of the entire domain industry.

Also important to note that if you infringe on someone else's trademark, there can be legal consequences beyond just losing the domain.

Sometimes trademark holders will not simply ask for the domain and want to sue you to serve as an example.

It's also important to note that many people don't just hand-register domain at $8 .. often times people invest hundreds of thousands in domains .. so trademark issues can be very important financially to some.

At some point in the UDRP process generally privacy is either removed, and/or the panellist will ask the registrar for the information. (The domain is usually frozen at the current registrar pending a decision)

A registrar might ask you to leave their registrar if they find you are someone who regularly registers problematic domains. However it's important to note that most registrars will not defend you or your domain in a UDRP .. that is your responsibility .. the registrar needs to comply with the UDRP decision.

I have had 3 attempts by FB to handover FaceBookXXX.com

They have failed each time and we also own eBayAuctions.com

Stay tuned...

Those are both severe trademark infractions ... what's your justification for owning them?

What do you mean by they failed each time? They certainly did not lose a UDRP as they would definitely win unless there's something extra you didn't mention.

Well we still own them. What's the big deal. They got outplayed by a bigger fish!
