I offered …... to ….. but the rejected the offer! Now although I did not knew it at the time of registration that it is illegal to do so! The reason I thought it was fine to offer because a certain Domain Broker Offered Credit to me but stipulated that …... should be also be transferred to the brokerage account that I have with them and also suggested me to sell this domain to the owner of …….! Please guide me members!

First of all you may want to obfuscate the comany name and domain names mentioned in the post. Post on NP ranks very high on search engine. Down the line, you may not want unwanted entities to read this conversation that can possibly have an adverse effects on your efforts. Something like this is fine.

I also have some more company names also but want to make sure it is not illegal to try to sell to them because if they are illegal I will delete them!

It is not illegal to send an email to someone. But if the email is unsolicited there may be some antispam laws that may kick in. But unsolicited emails are sent all the time. It is a fact of life. Point is - make some money out of the effort you put in to spam.

I personally know of a few very big sales that was done through outbound. Technically those emails were spam too. But who cares if the receiver is happy to get the domain !

Two things happen when you directly approach a potential buyer.
  1. You lose the negotiation power.
  2. You make it easier for them to win the case if they file a UDRP. They will use your email against you to prove that the domain was used in a bad faith. Then with the order from the UDRP panel, your registrar will happily award the domain to the complainant.
If you do not know what a UDRP is then you have got to read more about trademarks and such. NP is full of information.

Cases similar to yours has been discussed here several times. Next time if you have any specific issue try and search for relevant keywords. Chances are somebody already faced the issue and you may find a solution too.

Here is an idea.

There is a recent discussion here on NP wherein the domainer was stuck in a same situation as yours. Meaning he had a domain that he thought this company may be interested in, because he has the .com version and the business was using some secondary extension. So he goes to website of the potential buyer and sends them a message through their contact form.

The message says something like - Oh hey I am a potential/interested customer/client and I wanted to ask something about your service/product and have been sending emails to someone@exampledomain.com but never got a response. Then probably someone will revert on your email that you have got the extension wrong. Obviously you do not answer to their email coz all you want is for them to pay attention to the fact that they have been leaking leads to the dotcom extension. Now you pray that they come asking for your domain.

This strategy was successful for the domainer who revealed this idea. But of course it may not work for everyone everytime.

Thanks! I actually offered a company a domain name that is the name of its company also! They rejected the offer! Afterward someone told me that this is domain squatting and is illegal! I did not knew at the time of registration that a company existed with that name!

Hmm well a lot of domainers for example grab the dot com of a foreign company that is already using the exact same name in a different extension and then try to sell that name to the foreign company.

I mean yes if you’re trying to sell a parked unused UnDeveloped domain say msft.com to Microsoft that could be actionable as cybersquatting.

You’re using the wrong word though in any case it’s not illegal as in you go to jail for it. No jail. :xf.grin: I’d use the word “actionable” which in this case to keep it simple means only, “you could lose the domain.”

Whether or not you could lose the domain depends on a lot of factors and knowing only that you tried to sell a given company somewhere a domain name that was the same name as their company name doesn’t give us enough information to give you an accurate response. In other words, maybe yes maybe no.

Also, he has some more similar domains and will probably try and approach them too. I just threw some ideas I had. He clearly is a newbie that got a lot of catching up to do, including the concepts of rejection and moving on etc.

The domain is not cash parked right now but it is unused and undeveloped! It is only parked with the registrar of which I have no choice!

I can move forward! Not a problem! I just want to make sure that I do not delete domain name(s) that are not illegal and could have potentially made me money! That's it! If required I will delete them! Thank You Primary Names! I appreciate you response!

I Searched It but the word halaal trademarked combined with other world such as (Halaal Naan) (Live)
Does this make HALAAL Word or HALAAL Investments also Trademarked? Please Guide!

You were supposed to search for a tool on NP. Obviously NP is not a trademark registry engine.

Look for trademarkia or USPTO on Google. Honestly, you should be able to figure these things out on your own.

I apologize for not writing clearly! I actually searched it on UPSTO after searching on NP! Now I checked on Trademarkia also! No! HalaalInvestments.com is not trademarked in US!

No dont do this,

You should hold & let the companies come to your door.
it should be apparent from my posts that I am against spam.

And of course it is ideal to wait for the passive leads till we grow old and die.
