As much as we appreciate the .Club team and the extension, we certainly do not believe that Credit.Club is simply...hand reg unless he hand reg-ed it for a really, really premium price

Or if it was released from premium and he happened to be the right person at the right time to reg it

I can definitely state thought that the company had nothing to do with the credit.club registration at least intentionally. I don't even know who the registrant is. That being said, I am unsure of how this individual got this name. When I first saw it, I thought it was great name and a bit odd it was not on our reserve list. I even tweeted it thinking that it was just another great name registered. My 16 year old daughter registered 12 names with her Christmas money including increase.club, prosperous.club, and palmreader.club for $9.99 at Godaddy - the same week these names were registered. So although odd, I thought we might have just missed it on the reserve list.

With respect to credit.club I will task our council and tech teams to find out how and why this name got registered and provide further details.

I will be happy when the determination is done as the conspiracy theories were entertaining, but now really just getting out there. I am happy to talk to the tech or council teams at any point Colin if there is any information they need from myself as the registrant.

Unless the domain was officially taken off the premium list through meetings etc. and deem not worthy of 'premium' anymore, it is then a 'glitch' and glitches get returned to the register.

And it would only be fair to those making payments on six figure debts that someone doesn't get a one for $10

The registrant of credit.club commented on your twitter post on Jan 14th? You drop a name you have listed in startup.club for $200,000, and you don't take a few minutes to figure out what happend? How did the listing get erased from startup.club on Jan 14th as well?

Facts:


· The Operations Department, which manages Company domain name registrations, planned a transfer of <CREDIT.CLUB>, along with 130 other domain names, on 2015-01-13 as part of the Company’s Startup.club promotional program.


· On 2015-01-13T20:11:40, the Operations Department removed <CREDIT.CLUB> from the registry-reserve in order to register it as part of the Company’s Startup.club promotional program.


· Between 2015-01-13T20:11:40 and 2015-01-14T21:51:25 (25 hours, 49 minutes, and 45 seconds), the status of <CREDIT.CLUB> was unregistered and unreserved. At that time, the Operations Department did not have knowledge that the registration had failed. It is not clear whether the failed registration was a result of human error or system error.


· At 2015-01-14T21:51:25, a registrant (the “Registrant”) using domain privacy, without the knowledge of the Company, registered the domain <CREDIT.CLUB> at Name.com.




Analysis:


a) Mistaken Registration

The Registrant’s registration of <CREDIT.CLUB> on January 14, 2015 was due to a mistake made by the registry. The mistaken nature of the registration is clear as the domain name was publicly advertised as being a premium domain name in the Startup.club program and the Operations Department documented its plan to register the domain name to a Company subsidiary for promotional purposes. However, on January 13, 2015, when the Operations Department attempted to register <CREDIT.CLUB>, the registration failed, and the failure was not detected at the time.


b) Right to Rescind

The Registration Agreement between Name.com and the Registrant, the RRA between Name.com and the Company, and the Registry Terms and Policies all contemplate registrations that occur as a result of a mistake by the registry, and the registry may rescind such registrations.


c) Conclusion

Thus, it is within the Company’s contractual rights to cancel the registration for <CREDIT.CLUB>.


Further to his analysis and conclusions I can personally state that no one in .CLUB had any conversations regarding credit.club with the registrant at or before the registration of credit.club.

The registry does not believe it is in our best interest nor the best interest of the registrant to pull the name back given the substantial investment in time and money he has invested to launch credit.club. I informed the registrant of such matters and wish him a continued success.

The only piece of the puzzle that does not add up is why was the listing of credit.club removed from startup.club on Jan 14th if your transfer team was not aware of the transfer failure on Jan 14th?

If your employees removed the name from startup.club, they would have informed you of the error right away, and you would not have been in the dark for 2 weeks.

There will always be people looking for a negative story, or the opportunity to put a negative spin on someone's accomplishments. It is unfortunate that you guys had this kind of error occur, but I am glad that you are allowing this gentlemen to continue with his new business venture.

In my opinion Credit.club looks like a very well developed website, and seems to have the potential to make a great business. I'm sure @mindless will work hard to build it into something wonderful, thus highlighting the quality of a .club domain.
