I strongly urge any of you going into business with Dejan Lesicar (NamePros member @venturefile.com and owner of sites like sexydress.us) to be very cautious. He is about to cost our company Brandroot a lot of stress and money as we pursue serious legal action against him.

In short the details are as follows:

4/08/2014 - Dejan creates a Brandroot account
5/09/2014 - Wuvo.com is accepted and listed for sale at a price of $6750
09/29/2014 - Dejan requests that Wuvo.com be removed from Brandroot because "The name was accepted to an auction event."
10/14/2014 - Brandroot receives a $3,000 offer for wuvo.com
10/14/2104 - Dejan rejects and reminds us that he removed his name

We then remind him of his contractual obligation of keeping Wuvo exclusive to Brandroot for a period of 30 days following the request of removal.

10/15/2014 - In the interested buyer impatience he raises his offer to $4500.

Dejan is intrigued and writes, "Thank you for the update. That is a decent offer and I will seriously consider it." For several days Dejan is unresponsive, ignoring several of our emails.

10/22/2014 - In a matter of minutes of informing Dejan that he is no longer welcome to sell at Brandroot and that Wuvo.com will be removed, Wuvo.com sells at full price for $6750.

10/22/214 - Dejan decides that he does not want to sell Wuvo at Brandroot and that my email stating that his name was removed ended his contractual obligation with Brandroot (which the email in no way stated).

Our financial loss due to Dejan's unprofessionalism is not the concern. Brandroot is now left with one very unhappy customer threatening us with litigation. We have informed Dejan that we will stop at nothing, "making this venture of [his] a lot more expensive and stressful than [he] thought possible."

You've been warned. Dejan Lesicar is very capable of leaving you in one sticky situation if you enter into business with him.

Why is this thread now in Private Legal Discussion?

Can you please explain who moved it and why?

It started public, people have linked to it - the OP started it as a public thread.

Anyone following a link to it now just gets an error message - surely the url should explain the thread has been moved and take you to the new location, or the thread should just be moved back to the old, public url.

@Eric_Lyon or any other mod here needs to MAKE THIS PUBLIC. OP wants it to be public, as he's stated as much. You're going against the OP's wishes. This needs rectified.

The OP has made a mockery of NamePros, its members, and staff.

First of all he posts personal information about a private transaction between his company and a client.

Then when he got negative responses he resorted to name calling and insults.

Obviously realizing how poorly this reflected on him, the OP has entered cleanup mode. He started editing his original posts and changed his username not once, but twice. First he changed it to "The Moon" and now "Saturn".

Potential clients deserve to be able to read this thread and know who they are dealing with.

The fact that NamePros has facilitated the scrubbing of this thread and made it private makes me lose a lot of respect for this forum.

The OP mentioned that he don't wanna close this thread in previous posts.... but he will edit that statement and will make a request to close this thread.

Changing his username + editing his posts + hiding the thread = he knows he screwed up but is incapable of admitting it publicly. OTOH, who cares if he admits it? I don't see how that affects any of our lives one way or another. I think it's worth remembering that there are people on this site that have paid him money to promote their domains and that his success equals their success and that if his business fails they lose money too. Ultimately, he's either going to have to up his game or it's eventually going to catch up with him. In the meantime, I don't think that anyone that was angered by his comments is going to find any satisfaction here -- you're not going to get an apology, he's not going to admit that he was wrong, and you're not going to be able to destroy his business -- so it's probably best to move on and call it a day.

- For those interested, the stats are in. So far...

Two username changes, two profile photo changes, one removal of his Brandroot Staff banner, multiple insults aimed at his client base, and one company definitively brandrooted by its founder and CEO.

This is not right. Man up Rader. Right or wrong, take responsibility for your claims and actions.

I cannot imagine a domain company like Sedo, Afternic, Nodaddy outing a member like that - even for fraud. They would keep the dirty laundry private.

But we have a precedent at NP.
Donny once exposed a member for PPC fraud.
There was no such outcry at the time. The member in question was also doing business with other NP members, so there was a real possibility that NPers might buy domains with inflated traffic stats from him.

The present case is slightly different, because it's not fraud, and it doesn't affect us in the same way, it boils down to the interpretation of the TOS because they apparently were not crafted in a legal-proof manner. This is the biggest failure. Business lesson of the day: poorly written TOS leave you open to litigation.

Not taking sides here, but I am surprised that BR users are not allowed to remove/disable their own listings. BR says the request shall be honored "within 30 days". Do they send a formal notification when they expedite the request ? Or do you have to wait 30 days to be sure ? As a buyer, you need to know when and where you obligations end.

Ironically, Rader has also violated (I believe) his own TOS by publicizing details of a (non-completed) sale involving third party TM proceedings, no to mention the privacy violation vis-à-vis his former customer.

By the way, I think moving the thread was appropriate.
Not to protect the complainant or cover up, but also the protect the other party (aka the defendant).

This is not a TOS issue. This is a privacy policy issue and it is a serious violation of state/federal laws.

Aside from that, the thing that I find strange is that the TOS mentioned in this thread say nothing about the conditions of sale in terms of the seller-buyer relationship (including the logo). Brandroot is, I suppose, just a marketplace for connecting sellers and buyers and as such should never be making any warranty on the products purchased (domains + logo) and if they are attempting to do that through lousy terms of conditions then they are naive.

Sedo, for example, is clear in their documentation that they are a marketplace only. All legal liability is between buyer and seller and they absolve themselves as much as possible of problems. If a sale falls through - they pass on information and let you deal with it. For the sums involved its rarely worth the effort.

Gina had pointed out the exact issue discussed here prior to this thread - and nothing was done so I have little sympathy with Rader/BrandRoot.

I like small people to have success but it's not ever going to be easy running a business when you're relying on domainers. This is not a well regulated industry filled with ethical people. I imagine that it's very frustrating and very difficult - but I think this thread is a lesson in managing that.frustration and the value of hiring a decent lawyer to help you get things right.

To me BrandRoot has never been a business, it's been someone's hobby.... and there's a big difference, and that's what people are discovering.

Please, PLEASE tell me how you think just NamePro members gave me a business? You do understand that Brandroot had only ONE seller (myself) for over a year and a half, and only just recently (this year) began accepting sellers, and now again closing it off to new sellers (because of too many signups and long waits). The only reason Brandroot opened the marketplace to sellers was due to the extremely high demand and requests from domainers. The strict policies in place are to deter as many sellers as possible, which hasn't been working so we are no longer accepting seller accounts at this time.

So again, I would love to get your feedback on why you believe Brandroot thrived because of you. Our prime focus has ALWAYS been buyers and never sellers. We have never once advertised to get sellers at Brandroot. 0% marketing was put behind sellers.

And the thread went to private for legal reasons. It was not my choice but the lawyer handling the issue.

For those still pouting in this thread, seriously move on! There are things much more rich in life!

Hmmmm... I think your memory might be a little fuzzy on that one. I'm pretty sure that if I look through my emails I'm going to find a solicitation letter from you inviting me to move my 4 letter domain from brandbucket to you, and another unsolicited message from you offering me to list my domains for free.
