news Six Companies Form One UDRP Against Yoyo.Email

Spaceship Spaceship
I've followed Yoyo.Email with some interest ever since I learned that Giovanni LaPorta (CEO of Yoyo.Email) registered around 4,000 company .email domain names to create a "certified email service."

It seems, however, that Yoyo.Email's plans aren't supported by many companies - with over 50 UDRPs filed against Yoyo.Email so far. Today, I came across a case against Mr. LaPorta's company which involves six high profile complainants, all represented by one company.

AllSaints.email (All Saints Retail Ltd), MFC.email (Middlesborough Football and Athletic Co. Ltd), KarenMillen.email (Karen Millen Fashions Ltd), SSE.email (SSE Plc), RAC.email (RAC Motoring Services Ltd) and Randstad.email (Randstad Holding N.V) have all formed one complaint against Yoyo.email.

The UDRP case states:
The six organizations that form this complaint have a common grievance against the Respondent who has engaged in common conduct that has affected their rights in a similar fashion.

I don't follow UDRPs closely, but I've never seen six companies form one complaint against a single registrant before, but with Yoyo.email's track record, it's no real surprise (edit: see @Acroplex's comment below).

According to UDRPSearch.com, the complaint has been accepted and the panel has ruled that the domain names were registered in bad faith:

The Complainant has, to the satisfaction of the Panel, shown the Domain Name has been registered and is being used in bad faith

Brands will protect their identities online, no matter what the domain's intention; if it infringes their copyrights or trademarks, you're likely to hear about it.

They sure are making use of the outdated phrase, #YOLO...

I think this is going to cast new extensions in a negative light.
The amount of new extensions featured in UDRP rulings is rather disproportionate in view of their modest registration counts.

Some TLDs such as .suck engage in downright predatory and extortionist practices.
In .xxx more than 80% of the domains are inactive. Because most of those registrations are strictly defensive.

While Icann rake in the money, the brand holders foot the bill.

Sounds like Giovanni LaPorta will find his place as a speaker on the domainer convention circuit, or perhaps highlighted, on the domain name news webrags, as a shining example of what we should all aspire to. I've got a better idea. He should start a domain auction website where anything goes. Worry about the rest later.

Another case where 4 unconnected companies won a UDRP action at WIPO against yoyo, Laura Ashley Limited, BFS Group, Specsavers and Silentnight Group Limited.
