Autoresponder Service

I am considering starting a website that offers both free and paid autoresponders to the members. What legal implications are there if somebody is using the autoresponders to spam. Of course I'd have a NO-SPAM policy, and would delete accounts for members who are reported of spamming. Does anybody know more about spam laws and what could happen to a) me, or b) my website if somebody was spamming? Thank you for your input.
