I wanted to know are script clones legal ?

What do you mean do you mean eg: if i made a clone of phpbb it will be not legal?

Hi,

There is a few different meanings to what your saying here. : )

So, i will explain 3 for you.

If by cloning, you mean, make your own script, that has the same idea/concept as ebay, deviantart, myspace etc, that's fine, aslong as you made the script.

However, if you get a script, edit it, and release it for download as your own, that could interfer with laws depending on the license information of the original script.

Or, do you mean, just copy a site? say...you see a design you like, and you "rip" it? Save it...edit content etc (This isn't illegal, unless they have copyright, but it's not really fair now is it)

Yes, because popscript stole the scripts and/or don't have the rights to sell them.

However if you found those scripts from a legit source, they would be legal. I could script them for around that price, as I started one for a client before but they backed out - so i have half a script lying around.

They aren't legal - search google for popscripts.

@Hitch: yes, if popscripts made them then they would be 100% legal.

That is illegal if they steal the design. Designs are automatically copyrighted when they are made.

Copyright laws are kind of a maze to wander through. If I remember right if you put a (c) symbol on your work and trademark it wheather it be an idea, a plan, segment of code, or full program, whatever the work is then it belongs to you and cant be used without your permission. If you have a trademark or idea (patent) then the idea belongs to you.

In the UK only, Copyright's are free (as long as you can prove you did it first).

However in both the UK and the US, trademarks and patents costs hundreds/thousands.

There have been many file upload websites, there is no way that idea is patented.

It really depends.

First thing to check is whether the company has put a copyright sign at the bottom.
Second is to check whether any part of the site is patented, some might be.
Lastly, images are 'automatically copyrighted' to the owner, if they created it.
When cloning, the graphics must be changed to avoid copyright issues.

its copyrighted even if they dont put the little c and write out that its copyrighted, its automatically copyrighted the second you write/type it out. the copyright notice that most people put is just sort of liek a reminder not to steal it. its just like when people put "copyright 2006" if 2007 comes around and they havent updated it yet, that doesnt mean its not copyrighted anymore, it still copyrighted.
