I agreed a price of $3,000 for the development of a clone of King.com. He said that i could pay it in 3 stages at $1k each. This was back in October 2007 and he said it would take 2-3 months to complete. So i set deadline after deadline after deadline and he missed 11 in total and I started to get concerned. He maintained it was due to the complexity of the site and limited staff so i believed him. But when he missed the latest deadline, I sent an email asking where it was and he replied with:

He seems to have changed his tune and says he will have a beta by tuesday next week. whether he does it or not is another matter, but i think the idea of a lawsuit doesnt agree with him

I would contact him, and then team up with him, as he seems to be set, and you would just make the court case much easier on your side
You can always trust a person who reputation and ethics are much bigger then the amount you are paying him as advance.
The guys who want to run away with money doesn't have any ethics and they don't have hard rules in their life.
If he had refunded you the 1K then I think he would have found lots of otherways to make more money but with keeping his reputation intact.
And if he knew he cannot complete this project then he should not have taken it in first place.
That is why I laugh and roll on the floor when someone tells me he is a programmer. Because the basic rules of commercial programming is to deliver what you have promised. Not just give it a try and if it hits then money is yours stuff.

Some of those freelance sites CAN be trusted, but for me personally? It doesnt matter who I buy what from or who is offering me a service, I always check up on them. A little research will go a long way... Believe me. Not to sound like a stalker, but the easiest way to check someone out, obviously is A) if its on a forum of some sort, check their ratings, go to ANY negative comments they got and read every single one of them. Secondly I dunno about you, but when I trust my gut im %99.9 right. So if you can trust your instincts, go with them. And lastly (this WILL sound stalkery lmao) goto google. If they have a unique user name AKA SearchGuru1 you can find any activity they have been doing online. Oh I know. Ive ALMOST done deals with a few people that SEEMED trustworthy and then I had an inkling I should "check them out", turns out they dont have very good track records.
Just a thought.... considering you said you always get screwed over. Play safe. And italiandragon is def correct.. ALWAYS do escrow. Thats your safest bet. Even if theres an escrow fee of some sort? Wouldnt you rather pay the fee, then pay someone X amount of dollars, only to find out they scammed you and theres really nothing you can do about it?

Wow thats pretty sick the way hes talking to you. Its amazing a lot of people out there DO talk to people like that guy is talking to you.. and even do worse things. He probably didnt think you would paste that onto a major forum FOR all to SEE. Well, you did. And hopefully now when ANYONE reads this thread they WONT give any business to this guy.
Hey a mistake is a mistake. But this guy screwed you over with out a care, and obviously isint going to apologize or be a professional about it. Even if he was DEFENSIVE about what you were claiming? He didnt have a right to say the things he said. I find it to be incredibly insulting and baffling when people that are considered professionals " " talk to people however they want because they think they are above the law. Obviously this guy thinks EXACTLY that.
