I think they'll be likely to let Halloweeners slide.. this is a case of people using knock-off costumes for profit and Disney may be a giant but they have the right (and responsibility) to protect their trademarked characters.
I agree with you on that but.....Disney sued them after they returned the costumes to peru where they bought it(over ebay) to get a refund, they didn't sent them to disney....I think Disney is going over board here, instead they should go after the company who is infringing on them by selling unauthorized costumes and not after a small business...that just shows there is no common sense in big companies...hey they could have just given them permissions to continue for a small license fee...but no, they have to sue for millions :-(

Being a knockoff, I'm sure the quality wasn't as good or as accurate, so it's unlikely they'd have let the couple pay a "licensing fee". Think about it, it's a matter of trademark dilution too.. they can't let people indiscriminantly violate their trademark that they've spent billions branding. I'm all for the little guy, but I doubt they'll have to pay any sort of large settlement.. most likely it will be dropped at some point or a token fine (at most) will have to be paid.
Disney would never ok these people being Pooh, just one "Pooh touch my kid inappropriately" law suit isnt worth the risk. Not handing over the costume is a real big deal legally
ok ok guys, again i agree with you in general but my point is why not just let them destroy the "knockoffs", send them original costumes and charge a license fee...
And the fear of "Pooh touch my kid inappropriately" law suit is not really a good point imo, what about all the disney movies...don't you think they could used by sickos as phrase to capture a kid?("come with me, i show you the newest mickey mouse movie")...let's stop here, that makes me sick just thinking about it....
Why would they want to do that? they are using these people to set an example. Giving them original costumes to replace their knockoffs is hardly doing that. Disney will not care about the money, more they want to send out a single to others not to try the same.
The costumes are better than i thought they would be.
The real big thing that got them was putting the pics on the website, so easy to get caught that way
This couple problem is that they used "A List" cartoon characters. Stay away from disney, warner bros, peanuts if you have a birthday party business. Use "D List" cartoon charaters, like: Pete Puma, Alice the Goon, Beaky Buzzard, Sniffles the Mouse, The Three Little Bops, Apache Chief, Nibbles, Snidley Whiplash, Gossamer. lol
