Legal issue with pictures


Lets get some discusion started here.

Alot of sites host pictures that visitors send in, but whats the legal issue about it.

What about if someone send in a naked picture of a friend?
What Ive heard sites arent in trubbel if the fast take down the picture, but the damage is already done ?

Do you have any experience with this ?

i think when you run a site like that when people can upload any pic they like then you are asking for some sort of trouble.
its very hard to police the internet..so...i would think it would all depend on what it says in your terms and conditions of service. It should state that your site is not responsible for what a user ads to the site.

i run this buyselltemplates.com

I have been contacted by templatemonster/boxed art saying that take this one template down. But i dont think im responsible because its a person to person site.

Well the person who host it is resonseble for everything, but I dont think it works like that.

I would really like WORLD WIDE LAWS, that everyone can follow.
And they should be written just for internet, cause national laws these days are just really stupid.

We should get some lawyers here ^^

A lot can be done through a good TOS. However, you should be responsible for knowing your customers. This is because if something really bad happens, say someone uploads child p*rn, then the authorities will have someone else to prosecute. If you as site owner can't point to anyone, then the authorities might decide to prosecute you, if not for the actual deed, then at the very least for negligent behavior that made the criminal offense possible.

I know here in Sweden its very hard to run forums cause the owner is responsible for everything that is posted on the forum.

With pictures It have been if the site owner fast takes down pictures it often ends there.
