![]() ![]() ![]() | Anyone read "Wired" Magazine? There was a great article in there about Linus Torvalds (creator of Linux). Definately worth a read. If you did read it, what do you think about the lawsuit and open source development in general?

![]() ![]() ![]() | yeah but the law suit puts Linux at risk. Anyone using Linux would have to pay a user fee if they win the case.

![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() | here is a realy good bit of info to read http://www.mvista.com/sco-ibm.html#mean this is the part i like the best SCO, as the owner of Caldera, until recently made Linux available ROYALTY FREE to enterprise users, OEMs, and others. They did so in compliance with industry practice and in conformance to the GPL, which prohibits restriction of rights to redistribute code. “By distributing Linux products under the GPL, SCO agreed, among other things, not to assert certain proprietary rights - such as the rights to collect license fees _ over any source code distributed under the terms of the GPL.” (Lessig) SCO cannot now turn around and claim that their own distribution of Linux was any different from that of others, or that it was any more or less damaging. ????: NamePros.com http://www.namepros.com/showthread.php?t=16179 Basically, SCO’s Linux past assures the safety of your royalty-free Linux future |

![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() | Also, one thing SCO so far refuses to do is to detail exactly which part of the Linux code falls under their copyright claim. Until they do this, no judge will give them the time of day. SCO's dilemna is that the moment they make this identification, then volunteer developers would step up and replace the copyrighted code with pure GPL code. This would effectively 'cure' the alleged copyright infringement and allow open source to move on.

![]() ![]() ![]() | There's always a shadow of a chance. Although I agree they may win with that line of code and have to be compensated in some way by IBM, the open source world and Linux are not at risk as someone (as you mentioned earlier) will be ready and willing to replace that particular code with another. The other thing mentioned in the article was that Linus Torvalds (I think I spelt it right, he started Linux) sent an email that SCO got their hands on saying that he doesn't check the code for copyright issues because its too time consuming and frankly, he just didn't want to know. Willful blindness is no excuse under the law but I doubt something this minor will be an issue.
