If this is not overturned, it's a real downer for the 1st Amendment!

Also, of note: if you look at the domain names in this case, it is an example of being right up against the TM line by being a "journalistic" website, yet still profiting from the TM owner's product.

Meh, a real winner for employment contracts could be the other way to look at it ;-)
In other words, those who would seek to violate non-disclosure agreements can't simply hide behind commercial news websites.
