Verisigne to lose .net registry?


This is in the minutes to the meeting of ICANN over the last few days. From the text, it would appear ICANN is looking for a successor to the .net registry that may not be Verisign. I am assuming they can apply just like anyone else to get it again, but things may be stacked against them since the .com is such a huge prize, and they've lost .org recently when it came up for renewal.

Resolved, [04.18] that in order to prepare for the designation of a transparent procedure by 30 June 2004, the Board authorizes the President to take steps to initiate the process as specified in Section 5.2 of the .net Registry Agreement for designating a successor operator for the .net registry, including referrals and requests for advice to the GNSO and other relevant committees and organizations as appropriate.

If you look at the full text of the meeting minutes, they are going to re-bid the com/net registry and it's been clearly stated Verisign will be allowed to re-apply.

Given that they just handed them WLS, my guess is that WLS will go with whomever gets it next, including Verisign, again.

Doesn't anyone monitor these transactions? It seems VeriSign just does what it wants and no one is around to stop them...

Except they should probably not be lumped together. The .com agreement expires November 10, 2007. The .net agreement originally expires January 1, 2006, but was amended to expire June 30, 2005 with the following wierd stipulations based on performance that would take a team of lawyers and accountants to figure out:


5. MISCELLANEOUS PROVISIONS.

5.1.1.1.3.2 the NSI Registrar share of net new registrations of Registered Names in .com and .net, measured pursuant to Subsection 5.1.1.1.2, is 20% or less;

5.1.1.1.5 The Expiration Date shall be adjusted to 10 November 2003 if:

5.1.1.1.5.1 the share of total Registered Names in the .biz, .info, .name and .pro TLDs, measured pursuant to Subsection 5.1.1.1.1, is less than 10%, and

5.1.1.1.5.2 the NSI Registrar's share of net new registrations of Registered Names in .com and .net, measured pursuant to Subsection 5.1.1.1.2, is more than 25%;

or ICANN determines that Registry Operator is not in compliance with its obligations under Section 3.5 of this Registry Agreement, in accordance with paragraph 8 of Appendix I.

5.1.1.2 31 March 2004 Measurement Date. In the event a subsequent measurement as set forth in Subsection 5.1.1.1.4 is required, the subsequent measurement shall be calculated as follows:

5.1.1.2.1 The total number of Registered Names in all unsponsored gTLDs introduced by ICANN after 1 January 2001, including but not limited to .biz, .info, .name and .pro but not including .com and .net, as numerator, shall be compared to the total number of Registered Names in all unsponsored gTLDs recognized by ICANN, including .com and .net but not including .org, as denominator.

5.1.1.2.2 The net new registrations of Registered Names in the .com and .net TLDs (i.e., the net increase in the number of Registered Names sponsored in the registry) sponsored by the NSI Registrar for the period 1 April 2003 through 31 March 2004, as numerator, shall be compared to the total net new registrations of Registered Names sponsored by all ICANN-accredited registrars, including the NSI Registrar, in the .com and .net TLDs for the same period, as denominator.

5.1.1.2.3 The Expiration Date shall remain 30 June 2005 if:

5.1.1.2.3.1 the share of Registered Names in all unsponsored gTLDs introduced by ICANN after 1 January 2001, measured pursuant to Subsection 5.1.1.2.1, is 13% or more, or

5.1.1.2.3.2 the NSI Registrar share of net new registrations of Registered Names, measured pursuant to Subsection 5.1.1.2.2, is 22% or less;

and ICANN determines that Registry Operator is in compliance with its obligations under Section 3.5 of this Registry Agreement, in accordance with paragraph 8 of Appendix I.

5.1.1.2.4 The Expiration Date shall be adjusted to 1 January 2005 if:

5.1.1.2.4.1 the share of Registered Names in all unsponsored gTLDs introduced by ICANN after 1 January 2001, measured pursuant to Subsection 5.1.1.2.1, is less than 13%, and
