Then, they regged MARIO.MOBI It should not be allowed to regg a name like MARIO, PETER, JAMES, JOHN, etc !!! They should have a lot money to succeed registrating MARIO. Unbeleivable. | Hey People, It sort of depends on the type of registration as to whether a trademark can be or will be issued. If you look at www.mario.com, this registration belongs to a software company in which the owner's name is Mario. In this case, Nintendo cannot impose a trademark infringement since the individual's name and business reflects the domain registration. However......... Since this website has no content on it as of 4/17/2007, depending on the circumstances, Nintendo could open a court challenge for this domain if the individual cannot show that his business or operations is not actively using the domain or site. There is no requirement that a domain be in use, only that it not be registered in "bad faith". A non-competing website is evidence of good faith, as is having the name Mario, but that is not the standard.
