| my understanding is if you have a GENERIC term and a defined business plan that absolutely does not infringe on an existing tm of the same term, you're ok (eg- if you wanted to tm Apple, a tire company). if it is a non-generic, eg. microsoft, google, itunes, etc. you have no chance.
