![]() | Couldn't 'example.mobi' and 'example.com' be TMs in their own right? Another question: Couldn't 'example.mobi' and 'example.com' be TMs in their own right? As in, lets say the difference between 'Dan's Pizza' & 'Dan's Hardware' - they both would be business names but offering different services... Does a different extension indicate a different product? Hmmmm.....

![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() | If in your example, someone was lucky enough to TM 'Dans' and he sold hardware, someone else could legitimately TM 'Dans' and sell pizza. Dan the Hardware man, the earlier registration would be in trouble if he then started a pizza business as Dans pizza. Example Apple computers and the Beatles. Apple are now in the music business and conflict with the Apple music label (allegedly). GD we both posted together. |

![]() | Ofcourse the TM waters get muddied when the descriptive domain 'example 'changes to Pizza.com and Pizza.mobi, and Dan who owns the .mobi decides he wanted this to sell hardware using this.....lol.... This is why the Lawyers are filthy rich. GD. |
