Yes, I was always under that impression as well. I think you have to pay for the transfer fee out of 1and1 as well, which is the reason why most domain speculators tend not to use it.
Nope, you don't have to pay. I registered a domain with 1and1.com for $5.99. Then I transferred it RegisterFly with no problems. You need to UNLOCK the domain from 1and1 first before the transfer will go thru. My domain is still listed in my 1and1.com account but it resolves correctly and the whois shows my RegisterFly info.

No , I mean - There is a 60-90 day period when you first register a domain when you are not allowed to "Transfer" out. "Pushes" between Accounts within the Reg is different.

The URL above is for pushing a domain to another user on 1and1.com which they do charge for. They don't have it listed as a charge though on their info about registrar transfer. Never tried transferring a domain from 1and1.com, but it would definitely suck to have to pay again.
I actually did it a couple of days ago and forgot to post an update. You don't have to pay to transfer out, but you do have to pay to push. To transfer out unlock the domain (if it's not a .com or .net) hit the check mark by your domain name and then click on Info, then they provide you with the Authorization Code to transfer the domain out.
