Question .net reg of popular .com?


Hi all

Interesting thing cropped up recently. I work with some artists who asked me to do them a website, and as i was surprised to see the .net version of their "collective" name free, I regged it.

Anyway, while knocking the site together, i checked out the .com and was even more surprised to find what looks like an excellent idea/service there from a company in another country. I did some research and it seems very popular with thousands of people using it (and i can see why), but I'm guessing its only a couple of years old. I checked the official Trademark database of the country the company running it operates from within and it doesn't show as a trademark, even though its a very distinctive name (one word).

So anyway, I think I am on safe ground with this one but what would you do/what is your take on it? I feel like i've gone back 5 years and stumbled on an unregged "napster.net" - lol.

Check to see if the name is trademarked...it would suck to get in trouble

As i mentioned above, i have, and it isn't by the looks of it. I agree that TM's are a bag of worms worth avoiding

id see it as alittle unfair to copy there business of business idea but hey thats life, it is unfair

id try and sell them the .net

My use of the .net is very different to their use of the .com. My choice is really whether to develop as planned or put it to one side and reg another for my development.

The problem i have is that if they were to become very popular, we could make a lot more from afffiliation and promotion (or even reselling probably) from the domain than through the existing development. Or i could just ignore that and continue as planned...

OK - let me rephrase the question using a hypothetical business model:

If you saw a new ".com" music download service (like iTunes, Napster etc) that appeared to be growing fast and hadn't been TM'ed, and you owned the ".net", what would you do?
