Are you in Danger of losing your Generic .IN Domains?


Based on the discussion in the thread

I contacted Chris about his Business.in & Web.in domain names.
Aparetntly, he and his friend Daniel (owner of Jobs.in) has lost many of their generic domains in the Domain Dispute Resolution.

Here is the list of generic names lost in INDRP Dispute Decisions
jobs.in
web.in
business.in
internet.in
isp.in
computer.in
hotels.in


In the JOBS.IN Case the Complainant (Jagdish Purohit of Indiapress.org) Claims that he holds Trademark for “Jobs” and has applied for Service mark due to his usage of subdomain name Jobs.in.Indiapress.org

In the HOTELS.IN Case the complainant (DirectI Parent company of Skenzo.com the Paid Parking program) claims Hotels.in has been monitorzing using parked program and that they have right to the name because they have HOTEL.IN.DirectI.com subdomain and Hotel.IN
Its like the pot calling the kettle black and winning the case.

Most are genuine, but I do not agree with the resolution of generic domain names.

My advise to fellow domainers is, if you hold a premium keyword generic name, as a 1st step remove the "For Sale" posting immediatly.

Thanks for the heads-up. A whole series of unprofessional and wrong-headed decisions, basically implying that having a domain and intending to resell is bad faith.

In the case of Internet.in, they said that both parties were wrong and simply confiscated the domain without giving it to the complainant.

Looks like Mr. Jagdish Purohit is pulling a very dirty trick by creating trademarks for subdomains and using that as his leverage:

Notice that he hasn't won any co.in decisions.

Also, from the Jobs.in decision:

I agree completely with the Fonz... Investing in any ccTLD brings inherent risks. From what I've seen a lot (maybe all?) have their own dispute resolution policies, so you're at the mercy of said governing body and their rules and interpretations. This is true with any dispute, even .coms, but there is more precedance and other legal remedies available for the TLDs. You also have to worry about corruption in less stable countries, whether by government, the extension operators, whatever... If the Chinese government wants your xxxxx.cn, i'd say they're not gonna ask your permission before doing it, or offer dispute resolution

Time to develop the best generics, or at least stop parking and advertising them.

It looks like IndiaPress.org ( Or is it part of the registry?) may have been created as a front for holding generics that appear to have been "hijacked "- smells of something nasty.

Similar things happened at the .co.in premium names post landrush "non auction" I am just waiting to see where some of these reclaimed names end up to see if it all comes together and my long time suspicions are confirmed.

Lots of bad news in these cases but on the bright side:

1) We've learnt NEVER EVER to do business with anyone representing Indiapress.org or Directi. Whos to say they aren't making an offer simply to prove bad faith?

2) people don't go to court over bad domains. If you have LV.com you have a good chance of getting sued. if you have BGSFHFJVBN.biz no-ones going to bother with you. It could show that people are getting serious about the Indian domain space.

3) the upside of being part of a market with billions of potential customers still outweighs the risk of losing some domains.

4) Gives everyone an incentive - develop, develop, develop

I've got a sizeable investment in the Indian namespace myself, so this interests me.

Something else I recently noticed....

Police.in
FreeHosting.in
Private.in
Connection.in

I own the .Co.in for those (via purchases and drop catches), but all those .IN versions are now owned by "eNom Traffic". There are more examples of this, but those 4 are fresh on my mind.

I wrote to eNom Traffic inquiring about purchasing one of the .IN's that I hold the .Co.in for, and I got a friendly reply saying the name was not for sale. I wrote back saying my budget was "healthy", and got no further reply.

I suppose we should be flattered that eNom wants a piece of the Indian pie too.

I haven't had time to look into this very deeply, but I'm concerned. I have a lot of generic Indian domains, and most of them are parked (and listed for sale) at SEDO.
