Question Contracts

My mini-business is just about up, I only have a few more things to settle, and the biggest is the 'contract' I'll need my customers to sign.

Can I type it all up myself and get them to sign it?

Will the contract need to be composed by a lawyer or can it be composed by me and the lawyer only needs to review it?

Also, can the contract be "signed" by clicking an agreement / TOS button or will it have to be in signature (i.e. the customer will have to fax it or post it through regular mail)?

There are numerous "canned" contracts up for sale on the internet but I won't go that way to suggest it to you since of legality issues. Every business is unique and only you as owner knows where's it's planned to head.

You need to write all contracts, business plans at first yourself, forget first the terminologies at least you have drafted them first in your "own" words and sleep on it a day or two. After you've done your small research and draft contracts, then let the lawyer enter into the scene, this is so you'll know that you're heading in the right direction and everything's legal as specific in your place.

About the contract if it's "purely" online a digitally signed contract with their full name (middle name included) typed into it plus an upload facility for them to upload their identification data would be advisable. Fax and snail mail are advisable if you;re planning to get local clients.

I think a lawyer will not do in this case. Atleast our lawyers don't do much.

If you are doing your internet related business then there is no one other who understands it better then you. So you have to layout the basics and then go to lawyer and then polish it up.

Can I do the contract without a lawyer or is that too risky? I have a privacy policy made already, as well as a TOS...aren't these two things normally enough?

It won't be difficult for me to get a lawyer but I just feel the whole "contract" thing will scare customers away. If they agree to the TOS, then there should be no problem...

I have worked with contracts and without them, and I do find for larger jobs contracts do help unless you have 100% confidence in the client. I would check with a lawyer on this for sure, especially if you feel there could be issues with the client. just better to be on the safe side.
