Anyone theres gotta be a way i just want my domain

I've just emailed nominet the following-

Hi there

I have a really big problem that's starting to make me go mad,In January I bought the domain name blah.com with this being my first domain I never knew you needed a form to change the registrant information. So when the person I bought the domain name off transferred it to me via 123reg I thought safe thinking this was my domain.

Until I had an offer to sell the site after I went in to fulltime work, its been 5 weeks since I went to take that offer in that time I've been trying to get the old owner to send off the form to you lot signed and sealed,he asked me to pay £4 (Because I owned him") this Thursday he told me he had sent off the form and gave me a tracking number,After 4 days the letter hasn't turned up and it was sent 1st class the old owners now on holiday so I think hes scammed me.

What can I do I've phoned him, texted him but no reply,Legally the domain must surly be mine as its got my contact details plus he handed it over? I don't have the money to take him to court as I'm a student
????: NamePros.com http://www.namepros.com/showthread.php?t=87251

Could you please help?! the only proof I have would be 123 reg account, paypal and msn conversations

Thanks
Phil

How often did you try to contact this guy in the past few days? If it was several times a day, and over the weekend at that, then I'd understand why he would simply block you.

Phil, let me share you something a lot of people don't really know, much more
????: NamePros.com http://www.namepros.com/showthread.php?t=87251
care.

Registrars treat the listed registrant as the legal owner of the domain, no ifs
ands or buts. They don't care what happened behind the scenes and after,
it's only the registration records that matter.

If anyone wishes to dispute the ownership, that's what the courts or any
dispute resolution providers are there for. But it's a matter of proving you are
truly the legal owner, and that's a tough one.

Good luck.

You mean to prove to paypal or 123 that you own the domain? Uh uh.

If you sent your friend to buy cigarettes for you at the nearest convenience
store, who do you think the cashier will think owns the cigarettes once your
friend pays up?

If you understand the answer to that question, you'll then understand how
and why registrars treat it in a similar way.

OK GREAT NEWS!!! I got the form today but hes signed it but he hasn't filled in the "Print name box" and you have to write a letter to nominet saying you agree to hand over the domain hes wrote it on the back of mine.

If it was me, I would do it all for him. He has signed it, so he has already approved it. I would fill out the form where needed that he left blank. So much as the letter is concerned, If it's suitable, I would photocopy it and send that. If not, I would type it up for him and send it with an overnight prepaid envelope (whatever you guys have for fedex over there), making it super easy for him to quickly sign and be done with it.

That's just what I would do.
