The contract that was posted in this thread is not the current agreement. Regardless if any seller feels the current agreement is too restrictive, they can contact their Account Executive and some modifications can be made. The auto renewal clause was put in there for convenience so that the same customer wouldn't need to sign 15 agreements per year, 1 for each auction. However I can tell you the purpose of some of the restrictions are there is because Moniker deserves to be paid when it is our promotion and auction that leads to the sales. We are not trying to hold your domains ransom as some are suggesting and like others have said anyone that does not want to sell names at Moniker/Snapnames doesn't have to. However most auction houses with any experience and track record require an exclusivity period.

There are a lot of troubling restrictions and clauses in there that will and have driven many prospects off... and no auction house has an auto renew clause of the sort that I am aware of, nor has near the one-sidedness to them that your (supposedly old) one does.

Nobody is complaining that you shouldn't get your cut if your auction is was led to the sale. Nobody likes the super-one-sidedness and harshness of the contract (at least the old one). Obviously some people have read it and know exactly what to expect, and for some names is worth it.

Hopefully you have toned your "new" version down a lot based on the complaints and points made here. If so, this thread has served its purpose. Only time will tell.

Couldn't have said it better myself. After reading that last contract I would not be putting any names for sale at moniker. Of course I agree, they have the networks, if they lead to the sales it's only fair they get their cut and practically every domainer out there agrees with that and has no problem with it. I myself have not read the latest agreement to look for new changes, but time will tell!

And THAT, friends, is the power of the marketplace. They said it was because of their relationship with Snap, but I call BS. If people didn't stop submitting names after this, and I'm sure others, pointing out the flaws of the contract, it wouldn't have changed. They just won't admit it.
